5.05.010 Informal bid procedures.

Public projects, as defined by California Public Contract Code Section 22000 et seq., the Uniform Public Construction Cost Accounting Act (“the Act”) and in accordance with the limits listed in Section 22032 of the Public Contract Code, may be let to contract by informal procedures as set forth in Section 22032 et seq. of the Public Contract Code. 5.05.020 Contractors list.

The district shall comply with the requirements of Public Contract Code Section 22034. [Ord. 2023-005 § 3]

5.05.030 Notice inviting informal bids.

Where a public project is to be performed which is subject to the provisions of this chapter, the district shall circulate a notice inviting informal bids using one or both of the following alternatives:

A. By mailing, faxing, or emailing the notice to all contractors for the category of work to be bid, as shown on the list developed in accordance with WCWDC 5.05.020;

B. By mailing to all construction trade journals as specified by the California Uniform Construction Cost Accounting Commission under Public Contract Code Section 22036. The district may notify additional contractors and/or construction trade journals at its discretion, but if the product or service is proprietary in nature such that it can be obtained only from a certain contractor or contractors, the notice inviting informal bids may be sent exclusively to the applicable contractor or contractors. 5.05.040 Award of contracts.

The general manager, or his or her designee, is authorized to award informal contracts pursuant to this chapter. If all bids received are in excess of the informal bidding limits listed in Public Contract Code Section 22032, then the board of directors may, by adoption of a resolution by a four-fifths vote, award the contract up to the amount listed in Section 22034(d) of the Public Contract Code, to the lowest responsible bidder, if it determines the district’s cost estimate was reasonable.
