9.15.010 Definition.

For the purpose of this chapter, the words “public property” shall mean any publicly owned property, whether real or personal, within the town of Granby, except the traveled portion of the public streets, and shall include but not be limited to any parks, sidewalks, curbs or any part of any public right-of-way devoted to any planting or park-like use. 9.15.020 Injuring or destroying property.

(a) Injuring or Destroying Public Property. It shall be unlawful for any person to either willfully, maliciously, wantonly, negligently or in any other manner injure or destroy real property or improvements thereto, or movable or personal property, belonging to the town of Granby.

(b) Injuring or Destroying Private Property. It shall be unlawful for any person to either willfully, maliciously or wantonly injure or destroy real property or improvements thereto, or movable or personal property belonging to any person, persons, corporation, partnership or association.

(c) It shall be unlawful for any person to commit vandalism. A person commits vandalism when such person, without proper authorization, engages in the willful or malicious destruction, injury, disfigurement or defacement of any public or private property and where the aggregate damage to the real or personal property is less than $300.00. Vandalism includes, but is not limited to, any act of cutting, tearing, breaking, marking, drawing, painting or etching when such act is intended to damage property or has the effect of causing damage to property. 9.15.030 Taking down fence, bars, gate of another.

It shall be unlawful for any person to take down any fence or let down any bars or to open any gate in or on the property of another in the town of Granby without the consent of the owner, occupant or person in charge thereof. 9.15.040 Injury to or removal of street signs.

It shall be unlawful for any person, without proper authorization, to remove, deface, injure or destroy any street sign or sign erected or placed in or adjacent to any street indicating the name of such street. [Ord. 200 § 4, 1972. Code 1999 § 11‑1‑4].

9.15.050 Littering of public property.

(a) It shall be unlawful to throw or deposit in any street, alley, sidewalk or publicly owned grounds in this town, any paper, old clothes, cloth of any kind, boots, shoes, hats, leather, hair, grass, junk cars, straw or hay, trash or any other thing, except in public receptacles and authorized private receptacles.

(b) It shall be unlawful for any person, while a driver or a passenger in a vehicle, to throw or deposit litter upon any street or other public place within the town, or upon private property within the town. [Ord. 200 § 5, 1972. Code 1999 § 11‑1‑5].

9.15.060 Advertisements – Not to be thrown, deposited or posted in streets, alleys, etc.

It shall be unlawful for any person to throw any posters, dodgers, circulars, bills, letters, envelopes, samples or devices upon any of the streets, alleys, parks or public grounds of the town. [Ord. 200 § 6, 1972. Code 1999 § 11-1-6].

9.15.070 Handbills, posters and placards.

It shall be unlawful for any person to place any handbill, poster, placard or painted or printed matter which shall be stuck, posted or pasted upon any public or private house, store, or other building, or upon any fence, power pole, telephone pole or other structure without the permission of the owner, agent, occupant of the house or appropriate public official. 9.15.080 Truckloads causing litter.

No person shall drive or move any truck or other vehicle within the town of Granby unless such vehicle is constructed or loaded as to prevent any load, contents or litter from being blown or deposited upon any street, alley or public place. [Ord. 200 § 8, 1972. Code 1999 § 11-1-8].

9.15.090 Conduct on property open to the general public.

(a) Definition. For the purpose of this chapter, the words “property open to the general public” shall mean any publicly owned property, or property which is privately owned to which the general public has the privilege of access, within the town of Granby, and shall include, but not be limited to: any park, sidewalk, curb, restroom, washroom or any part of any public right-of-way devoted to any planting or public use.

(b) Unlawful Acts. On any property open to the general public, it shall be unlawful for any person to:

(1) Urinate or defecate, except in a public restroom, or in a private restroom with the permission of the owner thereof, or to exhibit any sex organs, male or female, within the eyes of the public.

(2) Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. No person over the age of six years shall use the restrooms and washrooms designated for the opposite sex, or use any real or personal property as a restroom or washroom.

(3) Construct or erect any building or structure of whatever kind, whether permanent or temporary in character, any tent, fly or windbreak, or run or string any rope, cord or wire into, upon or across any public property, except on special permit issued by the board of trustees. 9.15.100 Issuance of keys to town buildings and equipment.

(a) Any person having a need for a key or keys to any town building, including the Community Building located at 3rd and Jasper, or to any town equipment, shall apply to the town to possess such key or keys.

(b) If the application is accepted, permission shall be granted to the applicant upon such terms and for such period as is established, and the appropriate key or keys shall be issued.

(c) It shall be unlawful for any person to possess or use any key to any town building or equipment unless permission has been given. [Code 1999 § 11-5-3].

9.15.110 Theft.

It shall be unlawful to commit theft. A person commits theft when the person:

(a) Knowingly obtains or exercises control over anything of value of another without authorization or by threat or deception; and

(b)(1) Intends to deprive the other person permanently of the use or benefit of the thing of value; or

(2) Knowingly uses, conceals or abandons the thing of value in such a manner as to deprive the other person permanently of its use or benefits; or

(3) Uses, conceals or abandons the thing of value, intending that such use, concealment or abandonment will deprive the other person permanently of its use and benefits; or

(4) Demands any consideration to which he or she is not legally entitled as a condition of restoring the thing of value to the other person; and

(c) Where the value of the thing involved is less than $300.00. [Ord. 977 § 3, 2022].
