12.10.010 License.

There is hereby granted a license for encroachments onto the town’s streets and sidewalks, but not alleys, for fences, driveways, steps and retaining walls but only if said encroachments meet all criteria of this chapter. [Code 1999 § 14-5-1].

12.10.020 Date of existence.

The encroachment must have been in existence at the time of the adoption of the ordinance codified in this chapter. [Code 1999 § 14-5-2].

12.10.030 Location.

The encroachment must not be located on the traveled portion of any street within the town of Granby. [Code 1999 § 14-5-3].

12.10.040 Interference with pedestrian travel.

The encroachment, if located on town sidewalks, must not extend more than three feet from the private property line into the town sidewalk and otherwise must not interfere with pedestrian travel. [Code 1999 § 14-5-4].

12.10.050 Rights-of-way.

The encroachment cannot be located in a street that has a dedicated right-of-way of less than 50 feet in width. [Code 1999 § 14-5-5].

12.10.060 Expiration.

The encroachment license herein granted by the board of trustees of the town of Granby, Colorado, shall expire in the event that the town determines to improve its streets or authorize construction of water or sewer lines or other public utilities within the public right-of-way and said encroachment interferes with said construction; or it is necessary for the town to improve its sidewalks or lay, or authorize being laid, public utilities that need the space occupied by said encroachment. The encroachment license shall also automatically terminate upon the destruction or abandonment of the encroaching structure. [Code 1999 § 14-5-6].

12.10.070 Vested rights.

This chapter shall not vest any rights in any person or property except as herein provided. [Ord. 459, 1995. Code 1999 § 14-5-7].
