8.15.010 Permit required.

No person shall construct, build, establish, or maintain an open road cut or perform jacking or sleeving operations within the town of Highland without first obtaining a permit to do so as provided in this chapter. [Ord. 902, 1984. Code 1983 § 18-71; Code 2000 § 172.30].

8.15.020 Application – Accompanying documents.

No permit for an open road cut or a jacking or sleeving operation shall be issued until written application thereof has been made to the director of public works. Application for such permit shall be made on forms prescribed by the director, and shall contain the name and address of the person making application, his or her phone number, the reason for the application, the name of the insurance company providing the indemnification and maintenance bond, the policy number, the dates that applicant desires construction to begin and the estimated date of completion, and a sketch showing the proposed open road cut and/or jacking or sleeving operation. The plans and specifications of the proposed open road cut shall be filed with the director of public works at the time of making application for the permit required by this chapter, shall contain the limits of construction from right-of-way to right-of-way, being on a scale of one inch equals 20 feet, shall be governed by a north arrow, shall show the location of all underground utilities, shall show the proposed construction, and shall contain construction notes for restoration and safety. 8.15.030 Investigation of application – Necessary determination.

An application shall be approved and a permit issued only upon a determination of the director of public works and town council liaison to the public works department that the open road cut or jacking or sleeving operation will not create undue safety hazards in the use of the street or impede the safe and efficient flow of traffic upon the streets and sidewalks and adjoining the area where the open road cut or jacking or sleeving operation is proposed and, upon their determination, that the existing and proposed use of the road cut or jacking or sleeving operation in all respects conform with existing traffic, zoning, and building ordinances of the town. 8.15.040 Approval of plans and specifications – Prerequisite to issuance – Conformance with plans required.

No permit shall be issued for any open road cut or jacking or sleeving operation for any work to be done in or about the construction of an open road cut or jacking or sleeving operation until the plans and specifications thereof submitted pursuant to HMC 8.15.020 have been approved by the director of public works. A copy of such plans and specifications shall at all times be kept on file in the office of the director of public works. No alteration or change from such plans or specifications shall be made without the written consent of the director. [Ord. 902, 1984. Code 1983 § 18-74. Code 2000 § 172.33].

8.15.050 As-built plans to be submitted upon completion.

After completion of the construction of the said open road cut or jacking or sleeving operation and prior to acceptance of said construction by the town, the applicant must submit an as-built plan to the director of public works and said as-built plan shall remain on file with said director. 8.15.060 Applicants to file indemnifying and maintenance bond.

All applicants for an open road cut or jacking or sleeving operation must file an indemnifying bond to be in effect during construction and a maintenance bond to be in effect after construction in amounts to be specified by the director of public works. 8.15.070 Road cut permit fees.

(A) Permit fees for the construction of open road cuts or jacking or sleeving operations shall be paid prior to the issuance of a permit.

(B) A separate permit fee is required for each open road cut or jacking or sleeving operation.

(C) Said fee shall be paid to the town of Highland in the office of the clerk-treasurer, or a department the clerk-treasurer may identify.

(D) The permit will be valid for a period of 60 days. During the time of its validity, application for a refund for the full amount may be granted subject to a processing fee as fixed herein. No refund may be granted for any permit which has expired.

8.15.080 Revocation.

A permit issued under this chapter may be revoked by the director of public works for failure or neglect to maintain the open road cut or jacking or sleeving operation for which the permit was issued in good condition. [Ord. 902, 1984. Code 1983 § 18-78. Code 2000 § 172.37].

8.15.090 Enforcement.

This chapter shall be enforced by the town council and the council may invoke any legal, equitable, or special remedy for the enforcement of the provisions of this chapter. [Ord. 902, 1984. Code 1983 § 18-79. Code 2000 § 172.38].
