15.05.010 Prerequisites to occupancy permit.

No occupancy permit will be issued by the town until a water meter has been installed. [Ord. 670, 1973. Code 1983 § 5-1; Code 2000 § 210.001].

15.05.020 Fees and charges.

(A) Buildings. The permit issued under this section will be valid for a period of 180 days. During the time of its validity, application for a refund for the full amount may be granted subject to a processing fee as fixed herein. Extensions may be applied for and granted subject to the appropriate renewal fee. No refund may be granted for any permit fees on a permit which has expired. Refunds may be granted for the value of the permit, which represents inspection, wrecking and other related fees, in the full amount of the fees, minus any fees for services already performed, subject to a processing fee as fixed herein. In all cases, plan review is conducted in advance of the issuance of a permit and is not recoverable.

(B) The following fee schedule shall be in effect as indicated:

15.05.030 Penalty.

(A) Any person who violates any provision of this chapter for which no penalty is otherwise provided shall be subject to the penalty provided in HMC 1.05.170.

(B)(1) If any person, firm, or corporation shall violate any of the provisions of HMC 15.10.010 et seq., or shall do any act prohibited therein, or shall fail to perform any duty lawfully enjoined, within the time prescribed by the building inspector, the associate inspectors, or the building inspector’s designee, or shall fail, neglect or refuse to obey any lawful order given by the building inspector or the building inspector’s designee in connection with the provisions of HMC 15.10.010 et seq., for each such violation, failure, or refusal, such persons, firm, or corporation shall be fined in the amount set forth in the designated schedule as a payable offense subject to admission before the violations clerk or the ordinance violation bureau in the amount set forth in the admissions clerk payable offenses schedule in HMC 9.85.060.

(2) If such persons, firm, or corporation shall violate any provisions of HMC 15.10.010 et seq., and there is a failure to satisfy the civil violation as set forth in HMC 9.85.010 through 9.85.060, then such violations shall be construed as justiciable offenses and shall be subject to a fine of not less than $20.00 per violation, nor more than $1,500. Each day of such unlawful activity as is prohibited by the first sentence of this subsection shall constitute a separate offense.

(C) Any person, firm or corporation who violates or fails to comply with HMC 15.15.010 et seq., or any part thereof, shall be punished by a fine not to exceed $100.00. Every day any violation of HMC 15.15.010 et seq. shall continue shall constitute a separate offense.

(D) Any person who shall violate, or refuse to comply with, the provisions of HMC 15.20.010 et seq. shall be punished as provided in HMC 1.05.170. Any person who shall violate or refuse to comply with the provisions of HMC 15.20.010 et seq. will forfeit any and all plumbing permits that are in effect, or are to be issued, until he again complies with the provisions of said sections.

(E)(1) Any person who acts as a contractor, without first obtaining a license from the town council or its designee, as provided herein, or any person who continues to act as a contractor after his license has been suspended or revoked, shall be deemed to have violated HMC 5.20.010 et seq. and shall be fined in an amount not to exceed $2,500.

(2) Any person who fails to renew his license and continues to act as a contractor after the same has expired shall be deemed to have violated HMC 5.20.010 et seq. and shall be fined in an amount not to exceed $2,500.

(F) Any person violating the provisions of HMC 15.30.010 et seq. or the provisions of the Indiana Code as adopted herein shall commit a Class C infraction for each day that such violation continues and shall be subject to a penalty of not more than $500.00 for each violation, subject to execution as by law provided.

(G) Any person, firm or corporation who violates or fails to comply with HMC 15.35.010 et seq. shall be punished by a fine not to exceed $100.00 per day. Every day any violation of said sections shall continue shall constitute a separate offense.
