8.45.010 Burning within the town.

A. The outdoor incineration of the following materials within the town is prohibited:

1. Animal or vegetable garbage;

2. Shingles;

3. Tires;

4. Creosote materials; and

5. Petroleum and petroleum products, including but not limited to waste oil.

B. The outdoor incineration of leaves, tree limbs and branches shall be permitted on single-unit residential property or residential property containing four or fewer units between the hours of 9:00 a.m. and 5:00 p.m. and shall be permitted only in a noncombustible container with enclosed sides, a bottom, and a mesh covering with openings no larger than one-quarter-inch square; provided, however, such burning is prohibited in apartment complexes and mobile home parks.

C. Campfires and cookfires fueled by wood, charcoal or other heating or cooking fuel may be burned between the hours of 9:00 a.m. and 9:00 p.m.

D. Fires shall be attended at all times until completely extinguished. If it is determined by the [chief of police] that a fire is creating an air pollution problem, a nuisance or a fire hazard, it shall be extinguished.

E. No burning permitted hereunder shall occur on the surface of any paved street or alley, and the same is hereby prohibited and declared to be a violation of this section.

F. Notwithstanding the above provisions, no permitted burning shall be conducted during unfavorable meteorological conditions such as temperature inversions, high winds, air stagnation, etc. [Ord. 2008-11 § 5; Ord. 1992-01 § 2. Prior code Title 6, Art. 1, Ch. 2, § 4]

8.45.020 Violation.

Any person, firm or corporation violating the terms of WMC 8.20.070 through 8.20.090 or 8.45.010 may be fined in any sum not exceeding $50.00 for each day’s violation thereof. [Ord. 1992-01 § 3. Prior code Title 6, Art. 1, Ch. 2, § 5]

8.45.030 Burning on paved street.

A. The burning of leaves and rubbish on the surface of any paved street or alley shall be and the same is hereby prohibited and declared to be unlawful.

B. Authority. The street commissioner and [chief of police] are hereby given authority to enforce this section upon observing any violation hereof or written complaint of any person.

C. Penalties. Violation of any of the provisions of subsection A of this section may be punished by a fine of not more than $200.00 plus cost of repair. [Ord. 2008-11 § 5; Ord. 1984-05 § 10. Prior code Title 6, Art. 1, Ch. 1, §§ 1 – 3]
