8.55.010 Radios available for purchase.

Subject to availability and funding and as further set forth below, the town will make available for purchase, for residents and businesses in and around the town and town employees, warning radios that provide notification of weather-related emergencies (“warning radio program”). The radios will be a model and type approved by the National Weather Service and consistent with the brands used by Indiana Department of Homeland Security. [Res. 2012-16 § 1]

8.55.020 Cost subsidized.

The town will subsidize a portion of the cost of the warning radios for Whitestown residents and employees by supplying one radio to each applicable residential or business address within the town, and any town employee, at a discounted cost of $20.00 to the resident or employee. If a resident of Whitestown is unable to pay the full cost of the radio, he or she may apply to the town manager for financial assistance. The town manager shall review the application and determine eligibility for further subsidies, in the town manager’s discretion, based on funding availability and a list of nonbinding criteria which the town manager shall make available for any applicant. Certified applicants may receive a warning radio completely or partially subsidized by the town. Subject to availability, persons or businesses not residing within the town’s boundaries may purchase a radio from the town at cost. [Res. 2012-16 § 2]

8.55.030 Proof of residency required.

The discounted radios will be offered to residents who provide adequate proof of residency within the town of Whitestown, which may include but is not limited to a copy of a utility bill identifying the individual’s or business’s address. [Res. 2012-16 § 3]

8.55.040 Limit.

Only one radio will be provided per household or business. [Res. 2012-16 § 4]

8.55.050 Included in purchase.

Radios will be sold with batteries included and may be pre-programmed with the Boone County S.A.M.E. frequency for the National Weather Service. [Res. 2012-16 § 5]

8.55.060 Donations encouraged.

The town will encourage donations over the purchase price. [Res. 2012-16 § 6]

8.55.070 Warning radio program fund.

All funds received through this program shall be deposited into a fund dedicated to the warning radio program, and, unless otherwise approved by the town council, shall only be used for the purpose of providing radios, batteries, or other necessary items associated with the warning radio program. 8.55.080 Disclaimer.

The town will assist residents with questions concerning the warning radios; however, the radios are provided as-is. The town makes no warranties or representations of any kind, whether express or implied, concerning the warning radios, including but not limited to warranties of merchantability or fitness for a particular purpose, their condition, purpose, or programming, and shall not be liable for the radios or any alleged defects or damages arising from or related to the radios after purchase from the town. Each person obtaining a radio from the town shall sign a form acknowledging that the town has disclaimed all warranties with respect to the radios and further releasing the town from any liability related to the same. However, failure to obtain any such acknowledgment or release shall not invalidate the disclaimer of warranties or limits of liabilities set forth in this chapter or other applicable laws and ordinances. 8.55.090 Purchaser responsibility.

Purchasers or users are responsible for periodically checking whether the warning radio operates appropriately and for any damage or defects, and shall be responsible for replacement batteries and other maintenance and repairs. [Res. 2012-16 § 9]
