2.50.01 Grave space costs.

(a) The price of each adult grave space in all places of the city cemetery shall be $150.00 per space for residents of Baxter Springs, Kansas, and $300.00 per space for nonresidents of Baxter Springs, Kansas.

(b) The price of each infant space in the baby row shall be $50.00 per space for nonresidents of Baxter Springs, Kansas. (Ord. 710 § 2; Ord. 721; Ord. 783 § 2; Ord. 913 (5/10/16) §§ 1, 2; Ord. 913 (4/12/22). Code 1996 § 12-201)

2.50.02 Flat markers – Where used.

All grave markers or stones used in plats 10 and 11 of the cemetery shall be of the flat or ground-level type and shall be so set or placed that a mower will pass over them without damage to the stone or marker, or the mower, and no tall stones or markers and no stones larger than 24 inches wide and 48 inches long shall be used or placed in plats 10 and 11, and no mausoleums shall be placed in plats 10 or 11 except as provided in BSMC 2.50.09, and no shrubs, trees or plants shall be placed or permitted to grow on the lots or grave spaces which will not permit the mower to pass over them. Further, all grave markers or stones used in plats four and eight shall be of the flat or ground-level type and shall be so set or placed that a mower will pass over them without damage to the stone or marker, or the mower. 2.50.03 Vases – Hanging baskets – Flowers.

(a) Only permanent vases may be placed within the cemetery and must be approved by the cemetery sexton prior to placement in the cemetery. Vases shall be placed within or upon the headstone.

(b) Hanging baskets with a minimum basket height of 18 inches may be placed in the cemetery only if they are flush with the headstone. Hangers for hanging baskets and hanging baskets which are not maintained or are not in use shall be removed from the cemetery.

(c) Real or artificial flowers not regulated by this chapter shall be regulated according to signs posted in the cemetery from time to time. (Ord. 710 § 4. Code 1996 § 12-203)

2.50.04 Types of boxes.

No wooden rough boxes shall be used in said cemetery and only concrete or steel rough boxes shall be used. (Ord. 710 § 5. Code 1996 § 12-204)

2.50.05 Definition of resident.

For purposes of determining the price of an adult grave space to residents and nonresidents of Baxter Springs, Kansas, the following definitions shall apply: a Baxter Springs, Kansas, resident is a person who has resided in Baxter Springs, Kansas, for either the two years immediately preceding the death of such person, or for at least 10 years during his or her lifetime. A nonresident is a person who is not defined as a resident hereunder. (Ord. 710 § 6; Ord. 721. Code 1996 § 12-205)

2.50.06 Single spaces.

Repealed by Ord. 913 (4/12/22). (Ord. 913 (5/10/16) § 2)

2.50.07 Perpetual care fund.

Fifteen percent of the sale price of each lot or grave space hereafter sold in the city cemetery shall be placed in the perpetual care fund and the remaining 85 percent shall be placed in the cemetery fund of the city and used for the care and maintenance of said cemetery. (Ord. 913 (5/10/16) § 2)

2.50.08 Grave opening costs.

Hereafter the price of opening graves in the city cemetery shall be as follows:

(a) Opening adult graves, weekdays, $450.00;

(b) Opening adult graves, Saturday, $650.00;

(c) Opening adult graves, Sunday and holidays, $1,000;

(d) Standard cremation fees, weekdays, $175.00;

(e) Standard cremation fees, Saturday, $250.00;

(f) Standard cremation fees, Sunday and holidays, $300.00;

(g) Urn/vault cremation fees, Monday through Saturday, $225.00;

(h) Urn/vault cremation fees, Sunday and holidays, $400.00;

(i) Opening for infants, no charge for residents, $50.00 for nonresidents. (Ord. 783 § 3; Ord. 952. Code 1996 § 12-208)

2.50.09 Mausoleums.

Mausoleums used in plat 10, block six and plat 11, block one may be set or placed above ground level, it being the specific intent of this chapter to allow markers of the mausoleum type specifically in the said plat 10, block six and plat 11, block one. (Ord. 913 (5/10/16) § 2)

2.50.10 Setting of markers or stones.

Any company and/or individual setting markers or stones in any portion of the city cemetery shall obtain permission in the office of the city clerk during regular office hours before setting any marker or stone. (Ord. 710 § 11. Code 1996 § 12-210)

2.50.11 Decorations.

All unsightly or unattended flowers or decorations will be removed. Rocks, planting, fencing or digging around graves, markers, mausoleums or stones are prohibited and will be removed. City is not responsible for any stolen items from the cemetery or any damages to headstones, hanging baskets, vases or any other decorations located in the cemetery. (Ord. 913 (5/10/16) § 3)

2.50.12 Plat eight and plat four, blocks one, two, three and four.

(a) In plat eight and plat four, blocks one, two, three and four only headstones that can be mowed over will be allowed. Vases that are built into the headstone and can be turned upside down and will not interfere with the mower when not in use are allowed. These vases may only be used during the 14 days after a holiday and when it is not mowing season. All other times they must be upside down in the headstone.

(b) In plat eight and plat four, blocks one, two, three and four no hanging basket holder may be permanent. All hangers and baskets must be removed 14 days after the holidays and during the mowing seasons.

(c) In plat eight and plat four, blocks one, two, three and four there will be nothing placed on the graves that will impede or interfere with the mowing. Anything that is placed on the graves will be removed and discarded by the mowing crew.

(d) In plat eight and plat four, blocks one, two, three and four all other cemetery rules will apply.

(e) In the Baxter Springs Cemetery all headstones that are placed in any place but the headstone row must be of the flat mow over type, and must be placed down in the ground so that the mower can pass over it without damage to the headstone or the mower.

(f) The city will not be responsible for any damage to any headstone, hanging basket, vase or decorations in any plat in the Baxter Springs Cemetery. (Ord. 913 (5/10/16) § 3)
