ARTICLE 2. LOCAL TRAFFIC REGULATIONS

14-201. TRAFFIC CONTROL DEVICES AND MARKINGS.

The Standard Traffic Ordinance as adopted is hereby modified by adding thereto the following:

The governing body may, by resolution, establish and fix the location of such traffic control devices as may be deemed necessary to guide and warn traffic under the provisions of this chapter, other traffic ordinances and the state laws. The city shall place and maintain such traffic control signs, signals and devices when and as may be required by the authority of the governing body to make effective the provisions of this chapter and other ordinances for the regulation of traffic. Any official traffic control device placed pursuant to this section shall be marked and labeled on a map of the City of Nickerson for the purpose of displaying all such traffic control devices and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business.

14-202. U-TURNS UNLAWFUL.

(a)    It shall be unlawful for the driver of any vehicle to make a U-Turn anywhere within the city except where permitted at the intersection of two or more public roadways. An alley or driveway, even though used by the public, shall not be a public roadway for the purpose of this article.

(b)    A U-Turn is defined as a turning movement to the left across the flow of that traffic proceeding in an opposite direction for the vehicle making the turn, whether any traffic is actually proceeding in the opposite direction or not.

14-203. CARELESS DRIVING.

It shall be unlawful for any person to operate or halt any vehicle in such a manner as to indicate a careless or heedless disregard for the rights or the safety of others, or in such a manner as to endanger or be likely to endanger any person or property.

14-204. SCHOOL SAFETY ZONES; ESTABLISHED.

Nickerson Street from the north side of Avenue D to the south side of Nickerson Boulevard, and Avenue E from Peabody Street to Thompson Street, and Paine Street from Avenue P to Avenue E, and Avenue F from Peabody Street to Thompson Street, and the road on the east side of Blocks 1, 2 and 3 of Jordan’s Addition; and Nickerson Streets from the south line of Avenue G to the north line of Avenue J and Avenue H from the east line of Burr Street to the west side of Burr Street to the west side of Nickerson Street, and Morgan Street from the south side of Avenue H to the west side of Nickerson Street are hereby established as school safety zones. 14-205. SAME; SPEED LIMITED FOR CERTAIN PERIOD.

That during the period from the 1st day of September to the 31st day of May of each year, it shall be unlawful for any person to operate motor vehicles or any other type of vehicle within the school safety zones established in section 14-204 at a rate of speed in excess of 15 m.p.h. 14-206. SAME; SAFETY ZONE.

The chief of police or city superintendent shall place such signs or signals describing such school safety zones, as may be required and no person shall willfully deface injure, move or interfere with any such sign or signal. (Code 2014)

14-207. ESTABLISHMENT OF TRAFFIC CONTROL DEVICES.

The governing body of the city, may by resolution establish and fix the location of such traffic control devices as may be deemed necessary to guide, direct, control and regulate traffic within the city or to carry out the provisions of this chapter, and other traffic ordinances and the state laws; and the chief of police or city superintendent is directed to place and maintain such devices. 14-208. UNLAWFUL TO PARK CERTAIN TRUCKS.

It shall be unlawful to park a truck or truck-tractor with a registered gross weight over 16,000 lbs., or to park a bus, road tractor, farm tractor, trailer, or semi-trailer, regardless of weight, on a paved street in any residential area of the city, for longer than two hours, except as herein provided, to-wit:

That parking longer than two hours will be permitted when it is necessary for the loading and unloading of merchandise or goods and a permit, issued by the city clerk authorizing the same, is posted on the windshield of the vehicle at the time the vehicle is parked over two hours. These permits shall be issued for each instance over-parking is necessary,

14-209. TEMPORARY PARKING ZONES; SUPERCEDES GENERAL PARKING ORDINANCES.

The city superintendent shall have the power to establish temporary parking zones for funerals within the city in accordance with this article, and the temporary parking zones thus established, and the regulations therefore, shall supercede all general parking regulations of the city. 14-210. SAME; LOCATION.

The city superintendent may design temporary parking zones for funeral purposes in the block in front of any funeral home or church in which funeral services are being conducted and the parking zones may pertain to either, or both, sides of the street. The superintendent shall make such designation by the use of barricades, signs, or other suitable warning devices.

14-211. SAME; PARKING WITHIN ZONE.

Parking within designated temporary parking zones shall be permitted in double rows, or on the wrong side of the street, so long as traffic in the temporary parking zone does not obstruct all vehicular traffic through the street. The superintendent may restrict moving vehicular traffic through the temporary parking zone to one lane. (Code 1987, 8-404)

14-212. SAME; DURATION OF ZONE.

Temporary parking zones shall exist for a maximum of three hours prior to, and three hours after each funeral service conducted within the city. (Code 1987, 8-405)

14-213. WEIGHT LIMITATIONS.

It shall be unlawful for any person to drive operate, or permit to be driven or operated, any truck, semi-trailer or other commercial vehicle (including farm vehicles) having a gross weight in excess of five tons, upon any paved street, or portions thereof, in the city except on Nickerson Street, where no such weight limitation shall apply.

14-214. SPEED ZONES.

(a)    20 miles per hour zones. The following 20 mile per hour speed zones are hereby established within the city limits:

(1)    Edgemore Street from Avenue D to Nickerson Street;

(2)    Thompson Street from Avenue D to Paine Street;

(3)    Avenue E from Thompson Street to Peabody Street;

(4)    Paine Street from Avenue E to Avenue D;

(5)    Nickerson Street from Nickerson Blvd., to Railroad Ave., and from Avenue H to South Morgan Street;

(6)    Avenue A from Speare Street to Burr Street;

(7)    Avenue G from Speare Street to Burr Street;

(8)    Speare Street from Avenue C to Avenue A;

(9)    Burr Street from Avenue G to Avenue A.

(b)    30 mile per hour zones. All other public streets within the city (except that portion of Highway K-96 governed by state law) are hereby designated as 30 mile per hour zones.

14-215. THROUGH COMMERCIAL TRAFFIC.

(a)    Prohibited. Through commercial vehicles are prohibited on Holiday Street in the city.

(b)    Commercial Vehicle Defined. A commercial vehicle, as referred to in the preceding paragraph, shall consist of all truck/tractors, trucks and pickups of any kind and description used in business other than farming with a weight in excess of 40,000 pounds.

14-216. ENGINE BRAKE USAGE PROHIBITED.

It shall be unlawful for any driver of a truck or truck-tractor to activate or use the unit’s Engine Brake within the city limits except in an emergency situation. The term emergency situation, for the purpose of this article, shall mean one in which there is imminent danger of collision with property, persons, or animals. (Ord. 98-13, Sec. 1; Code 2008)
