DISPOSAL, LEASE AND SALE OF TOWN PROPERTY

Pursuant to the town’s self government powers, Section 7-8-4201, Montana Code Annotated, dealing with the disposal, lease or sale of town property is hereby superseded with respect to the property described in Section 2.12.020. (Ord. 160 (part), 1994)

2.12.020 Disposal, lease or sale of town property.

The town council may dispose of, lease or sell the property described below, owned by the town, by a resolution passed by a majority of the town council members present. If the resolution is for sale of the property, such sale shall be held at a public auction, with the property to be sold to the highest bidder. Prior to such auction, the town manager or his designee shall publish a notice in the legal newspaper of the town setting forth the town’s intention to sell such property at public auction, describing the property, and stating the date, time and place of the auction. Such notice shall be published at least fourteen days in advance of the public auction.

The property to which this chapter applies is described as follows:

All that part of the South One-Half (S 1/2) of Lot 5 in Block 8 lying South of U.S. Highway 191 (a/k/a Highway 20), as now established over and across said lot in the townsite of West Yellowstone, Montana, according to the official plat thereof on file and of record at the office of the Clerk and Recorded of Gallatin County, Montana, and as shown on that certain Right-of-Way and Tract Map filed for record on the 28th day of December, 1987, at 10:10 o’clock a.m. under Permanent File No. 1947-S in the office of the Clerk and Recorder of Gallatin County, Montana.
