18.25.010 Violations of this title may be restrained.

In the event that any building or structure is erected, constructed, reconstructed, altered, repaired, converted or maintained, or any building, structure or land is used in violation of this title or other regulation made under authority conferred by this title, the mayor and council may, in addition to other remedies provided in VCMC 18.25.020, institute any appropriate action or proceedings, to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use; to restrain, correct, abate such violation; to prevent the occupancy of such building, structure or land, or to prevent any illegal act, conduct, business or use in or about such premises, and in addition thereto the mayor and council may institute appropriate court proceedings for civil damages resulting from such violation; and the proceedings provided for in this section are not intended to in any way limit the right of other injured parties to seek civil damages for any violation inflicted upon him/her or them by anyone acting in violation of the provisions of this title, or in violation of the zoning plan adopted by this title. 18.25.020 Penalties for violation.

Any violation of the terms of this title or of the provisions of the zoning plan adopted by this title or any violation of any order or resolution made or passed by the mayor and council for the carrying out or enforcement of the provisions of this title are hereby declared to be a misdemeanor, and any person, persons, firm, corporation, copartnership or association violating any section of this title or any order or other directive made and issued for the carrying out of the provisions of this title, shall, upon conviction, be fined not more than $200.00 or be imprisoned in the county jail for not more than six months, or by both such fine and imprisonment, in the discretion of the court; each violation shall constitute a separate offense.
