17.48.010 Description and purpose.

The purpose of the business park district is to provide a mixed-use zone for light industrial and commercial uses. Retail trade is permitted as an accessory use or when determined to be compatible with, or can be made compatible with, light industrial or wholesale trade uses via a discretionary review process. Site plan and/or conditional use approval standards are designed to ensure the compatibility of the light industrial uses with the commercial uses, and the compatibility with adjacent zoning districts. 17.48.020 District boundary designation.

The area designated as the Eagle Point business park district shall be limited, exclusively, to those lands on the west side of Highway 62, between Linn and Nick Young Roads, to the western boundary of the Lenn Hannon Road right-of-way. [Ord. 2004-08 § 2 (Exh. B § 3.411)].

17.48.030 Permitted buildings and uses.

The planning commission may grant site plan approval, under the provisions of Chapter 17.52 EPMC, Special Uses, General Provision and Exceptions, and Chapter 17.60 EPMC, Site Plan and Landscape Approval, as applicable, for the following uses:

A. Accessory uses and buildings customarily appurtenant to a permitted use, such as incidental storage when properly screened.

B. Ambulance service.

C. Assembly, manufacture, or preparation of articles and merchandise from the following previously prepared types of materials: bone, canvas, cellophane, cloth, cork, feathers, felt, fiber, precious or semi-precious metal or stones, shells, textiles, tobacco, wax, wire, wood (excluding sawmills, lumber mills, planing mills and molding plants), yarns and paint not employing a boiling process.

D. Automobile, motorcycle, truck and equipment sales, service, repair and rental.

E. Bakery, wholesale and retail.

F. Boat building, sales and repairs.

G. Buildings and uses owned by the city of Eagle Point.

H. Cabinet shop.

I. Ceramic products using only previously pulverized clay and fired in kilns using low-pressure gas or electricity.

J. Communications, navigation control, transmission and reception equipment, control equipment and systems, guidance equipment and systems.

K. Computer items.

L. Data processing equipment systems.

M. Electronic or electro-mechanical equipment manufacture, assembly, testing and repair for items such as, but not limited to:

1. Radios and televisions.

2. Audio and phonographs.

3. Metering instruments.

4. Radar, infrared and ultraviolet equipment.

5. Coils, tubes, semi-conductors and other components.

N. Existing residences and additions thereto.

O. Garment or clothing manufacturing.

P. Glass assembly and manufacturing.

Q. Home occupations in existing residential dwellings only subject to EPMC 17.52.100.

R. Light manufacturing, assembly, fabricating or packaging of products from previously prepared materials such as cloth, plastic, paper, leather, precious metals or stones.

S. Machine, metal and sheet metal shops.

T. Manufacture and sale of scientific and chemical instruments.

U. Medical aids manufacturing such as artificial limbs, dentures, hearing aids and surgical instruments or dressings.

V. Musical instrument manufacturing.

W. Novelties manufacturing.

X. Off-street parking lots, garages and loading facilities.

Y. Optics (precision) manufacture and assembly.

Z. Outdoor storage uses (which shall be completely screened from public view), such as contractor’s storage yards, lumber and building materials sales (but not including concrete or asphalt batch or mixing plants), equipment rental agencies, etc.

AA. Pharmaceutical laboratories.

BB. Printing, publishing and book binding.

CC. Radiator service and repair.

DD. Retail stores and shops supplying commodities or performing services in which a portion of the floor area is used for manufacture of items sold on the premises.

EE. Retail uses involving outdoor display, such as automobile, motorcycle, truck, recreational vehicle, trailer, or mobile home sales, plant nurseries, etc.

FF. Scientific research or experimental development of materials, methods or products including engineering and laboratory research.

GG. Sign shops and signs.

HH. Storage buildings and mini-warehouse facilities for household goods.

II. Storage buildings and warehouses for consumer goods.

JJ. Temporary uses and sidewalk sales approved by the city council.

KK. Warehouse or mini-storage facilities.

LL. Welding shops.

MM. Wholesale facilities for distribution of all standard types of prepared or packaged merchandise such as automobile supplies, drugs, electrical supplies, furniture, food products, hardware, leather goods, plumbing supplies, textiles and fabrics and general merchandise.

NN. Other uses similar to the above and keeping with the business park district purposes; provided, that the use is not harmful to persons living or working in the vicinity as determined by the city due to odor, smoke, dust, dirt, refuse, illumination, noise, vibration, appearance or hazard of fire or explosion. 17.48.040 Buildings and uses permitted conditionally.

The planning commission may grant a conditional use permit in accordance with the standards and procedures set forth in Chapter 17.84 EPMC, Conditional Use Permits, and Chapter 17.52 EPMC, Special Uses, General Provisions and Exceptions, as applicable, for any such other buildings or uses as the commission determines to be in keeping with the district purposes. The planning commission may consider any detrimental effect(s) upon the adjoining neighborhood areas. In addition, the following are conditional uses which may be authorized, and for which a conditional use permit is required:

A. Administration, educational, business offices and other related activities and facilities in conjunction with a permitted use.

B. All allowable uses not conducted wholly within a permanent, fully enclosed building, except off-street parking facilities, temporary uses, and sidewalk sales.

C. Any uses, including those listed as permitted uses above, which, in the opinion of the planning director, are of a size, character, or location such that they may cause disturbing, dangerous, or damaging noise, odor, traffic, vibration, hazard of fire or explosion, or similar impacts on surrounding properties.

D. Automobile service stations and related uses.

E. Bulk meat processing and sales.

F. Food products processing and manufacturing.

G. Planned unit developments subject to the provisions of Chapter 17.76 EPMC.

H. Public and semi-public utility and service buildings, structures and uses.

I. Residential uses related to the operation of permitted industrial uses for plant personnel.

J. Retail stores and shops supplying commodities or performing services, with a gross floor area containing more than 50,000 square feet. [Ord. 2004-08 § 2 (Exh. B § 3.413)].

17.48.050 Prohibited uses.

Any/all “drive-thru” windows are prohibited in the zone. [Ord. 2005-12 § 1 (3.413 (A))].

17.48.060 Yard requirements.

In the BP district, each lot shall have yards of the following size unless otherwise provided for through Chapter 17.52 EPMC, Special Uses, General Provisions and Exceptions, Chapter 17.60 EPMC, Site Plan and Landscape Approval, or Chapter 17.56 EPMC, Street Dedication and Building Setback Requirements:

A. Front yard setback: 35 feet. Exception: parking area setback, five feet.

B. Side Yard Setback.

1. Commercial or industrial adjacent zone: 10 feet.

2. When adjacent to a residential zone: 50 feet.

C. Street side yard setback: 35 feet. Exception: parking area setback, five feet.

D. Rear Yard Setback.

1. Adjacent to commercial or industrial zone: 20 feet.

2. Adjacent to a residential zone: 50 feet.

E. Highway 62.

1. Buildings: 15 feet. The setback shall be measured from the Highway 62 right-of-way boundary.

Note: A minimum of the initial 10 feet abutting the ROW line shall be landscaped.

F. Screening from adjacent residentially zoned property with landscaping and/or fencing is required. [Ord. 2004-08 § 2 (Exh. B § 3.414)].

17.48.070 Building or structural height limitations.

In the BP district, there shall be no building or structural height limitations. [Ord. 2004-08 § 2 (Exh. B § 3.415)].

17.48.080 Lot regulations.

A. Area and Dimensions. In the BP district there shall be no lot area or dimension requirements.

B. Coverage and Density Requirements. In the BP district, there shall be no lot coverage and density requirements, except as provided in the yard setback and off-street parking requirements. [Ord. 2004-08 § 2 (Exh. B § 3.416)].

17.48.090 Parking requirements.

Off-street parking and loading requirements for uses in the BP district shall be provided as prescribed in Chapter 17.72 EPMC. In no event shall there be less than adequate parking and loading facilities to serve all employees, customers and service needs of each use. [Ord. 2004-08 § 2 (Exh. B § 3.417)].

17.48.100 Fences and walls.

In the BP district, solid fences and walls shall not exceed three and one-half feet in height above the sidewalk grade, within the front yard setback area or street side yard setback area. Vision clearance shall be required on all corner lots. On an interior lot, a wall, fence or hedge not more than eight feet in height may be located anywhere on the lot to the rear of the required front yard or street side yard setback line. When a BP district adjoins a residential district, the planning commission may require that a fence, wall or hedge be erected along and immediately adjacent to the abutting property line that is the zone boundary. The planning commission or site plan committee may make this requirement in the approval of the site plan as required by Chapter 17.60 EPMC. All fences, walls and hedges shall be properly constructed, maintained, trimmed and kept in good condition and repair. [Ord. 2004-08 § 2 (Exh. B § 3.418)].
