Article I. General Provisions

13.55.010 Purpose – Application.

The purpose of this chapter is to adopt the city’s water curtailment plan and to provide a process for curtailing outdoor water uses to assure adequate flow for fire protection and other essential water requirements throughout the periods of water shortages or threatened water shortages. This chapter shall apply to all city water users. [Ord. 1231 Art. I § 1, 2015.]

13.55.020 Administration.

The provisions of this article shall be administered as follows:

A. The public works director shall inform the city administrator when water consumption threatens to exceed production or threatens the available water storage levels necessary to meet fire protection and other essential water requirements.

B. Upon notification from the public works director, the city administrator shall decide whether to curtail water use, as more specifically described in the city’s water curtailment plan, which is attached to this chapter as Exhibit A and by this reference is incorporated herein.

C. If the city administrator decides water curtailment is necessary, the city administrator or designee shall prepare a resolution for the council declaring a water emergency and, in consultation with the public works director, shall decide to impose either: (1) a voluntary Alert Stage No. 1 (mild water emergency); (2) an Alert Stage No. 2 (moderate water emergency); or (3) an Alert Stage No. 3 (severe water emergency), all of which are further described in the city’s water curtailment plan.

D. Before imposing a water curtailment plan or upgrading an existing water curtailment plan, the city administrator or designee shall post notices in at least three conspicuous places in the city. The city administrator shall also place an announcement in the newspaper of general circulation within the city, if time and conditions permit placing such a newspaper announcement. Any such notice or announcement may be effective immediately, shall include an effective date, and shall inform the reader where he or she can find the exact curtailment requirements being imposed.

E. The curtailment restrictions shall remain in effect until such time as the city administrator finds that the conditions which gave rise to the restrictions no longer exist. At such time, the city administrator shall declare the curtailment measures terminated, effective immediately upon announcement, or at a later date selected by the city administrator. [Ord. 1231 Art. 13.55.030 Water restrictions.

Once the city administrator has provided notice of water curtailment, water usage will be regulated or restricted as more specifically described in the city’s water curtailment plan. The city administrator shall implement one of the following Alert Stages:

A. Alert Stage No. 1, mild water emergency (Section 4.4.1 of the water curtailment plan); or

B. Alert Stage No. 2, moderate water emergency (Section 4.4.2 of the water curtailment plan); or

C. Alert Stage No. 3, severe water emergency (Section 4.4.3 of the water curtailment plan). [Ord. 1231 Art. I § 3, 2015.]

Article II. Enforcement

13.55.040 Enforcement.

As provided in the Eugene Water and Electric Board Customer Services Policies and Procedures Manual for Water Utilities, which was adopted by the city, for a first violation involving unauthorized use of water during curtailment, the city shall provide a written warning, citing the date and type of water usage violation. For a second violation, the city will provide a written notice of violation, citing the date and type of water usage violation; and may also, at its sole discretion, impose a $300.00 fine and/or terminate city water service. A city water user who continues to violate a water curtailment plan after being issued a notice of a second violation may be subject to a $300.00 fine for each additional day the water user violates the water curtailment plan. Article III. Validity and Emergency

13.55.050 Validity.

The invalidity of any section, clause, sentence or provision of this chapter shall not affect the validity of any part or section of this chapter which can be given effect without such invalid part(s). [Ord. 1231 Art. IV § 1, 2015.]

13.55.060 Emergency.

It is hereby adjudged and declared that existing conditions are such that this chapter is necessary for the immediate preservation of the public peace, health and safety of the city of Junction City, and an emergency is hereby declared to exist and the ordinance codified in this chapter shall take effect and be in full force and effect upon its passage by the council and approval by the mayor.
