2.54.010 Establishment of public library.

Lincoln City’s library was established by Resolution No. 93 and reestablished by Resolution No. 80-09 as a public library in the city, under the provisions of Oregon laws relating to public libraries, specifically ORS 357.400 through 357.621. The library is named the Driftwood Public Library. (Ord. 2003-22 § 1)

2.54.020 Purpose.

The purpose of the Driftwood Public Library is to provide and make accessible to all residents of the city library and information services suitable to persons of all ages. (Ord. 2003-22 § 1)

2.54.030 Financing of public library.

The Driftwood Public Library shall be financed through revenues from the general fund of the city. (Ord. 2003-22 § 1)

2.54.040 Library board – Established – Membership.

The library board is hereby established and shall consist of eight members. One of the members shall be a student who is registered at and regularly attending high school within the city at the time of appointment and throughout his or her term of service. To be eligible for appointment to and continued service on the library board, a person, at the time of appointment and throughout his or her term of service, must be a resident of the city, except that two members may be residents within the urban growth boundary of the city and the student member may be a resident of Lincoln County within the boundaries of the Lincoln County School District – North Area. Voter registration records may be used to determine residency of adult members.

Notwithstanding any other provision of the code, the term of office of the high school student member shall be one year, commencing July 1st of each year. (Ord. 2017-05 § 9; Ord. 2007-04 § 1; Ord. 2007-03 § 1; Ord. 2003-22 § 1)

2.54.050 Financial interest – Expense reimbursement.

No member of the library board or the city council shall have any financial interest, either directly or indirectly, in any contract to which the Driftwood Public Library is a party, nor receive a salary or any payment for material or services provided to the board. 2.54.060 Board chairperson and secretary.

The library director shall serve as secretary to the library board and keep a record of its actions. (Ord. 2017-05 § 9; Ord. 2003-22 § 1)

2.54.070 Library board powers and responsibilities.

A. The library board shall be an advisory board to the city council.

B. The library board shall make recommendations and advise the city council in the following matters:

1. The creation and revision of library policy, rules, and regulations.

2. Providing assistance to the library director in long range planning and preparation of the annual budget recommendations to the city manager for presentation to the city council.

3. Making recommendations to library director on program development.

4. Making recommendations to the library director in the case of a materials challenge (i.e., when a citizen asks the library director to withdraw an item from general use).

5. Acting as the library’s ambassadors to the community at large by fostering interest in library services and providing a point of contact for complaints or requests for service.

C. The library board shall have no power or responsibility for:

1. Entering into contracts.

2. Financial matters, except to act in an advisory capacity in the formulation of an annual budget.
