10.04.010 Title – Citation.

The ordinance codified in this title may be cited as the “Lincoln City traffic ordinance.” (Ord. 88-8 § 1)

10.04.020 Adoption of Oregon Vehicle Code.

ORS Chapters 801 through 822, as constituted on November 4, 1993, are adopted by reference. Violation of an adopted provision of those chapters is an offense against the city. (Ord. 93-16 § 1; Ord. 88-8 § 2.01)

10.04.030 Adoption of procedural statutes.

The procedures applicable to the prosecution of traffic offenses as contained in the Oregon Revised Statutes, as constituted on November 4, 1993, including but not limited to the procedures set forth in ORS Chapter 153, are by this reference adopted in full and made a part of this title. 10.04.040 Continuity between references.

A reference in any ordinance, resolution or regulation of the city to any state statute repealed on January 1, 1986, by Oregon Laws 1983, Chapter 338, Section 978, is deemed to be a reference to the corresponding section of Chapter 338, Oregon Laws 1983, as amended by Chapter 16, Oregon Laws 1985, which is codified in the Oregon Vehicle Code, ORS Chapters 801 through 822, which is adopted pursuant to LCMC 10.04.020. 10.04.050 Definitions.

In addition to the definitions in the Oregon Vehicle Code, as adopted pursuant to LCMC 10.04.020, the following mean:

“Bus stop” means a roadway space designated by sign for use by buses to load or unload passengers.

“Holiday” means New Year’s Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day, and any other day proclaimed by the city council to be a holiday.

“Loading zone” means a roadway space designated by sign for loading or unloading passengers or materials during specified hours of specified days.

“Ocean shores” means the land lying between extreme low tide of the Pacific Ocean and the line of vegetation as established by ORS 390.770.

“Overnight” means between the hours of 2:30 a.m. and 5:00 a.m.

“Person” means a natural person, firm, partnership, association or corporation.

“Street” means highway, road or street as defined in ORS 801.110, 801.305, 801.450 and 801.535, including the entire width of the right-of-way.

“Taxicab stand” means a roadway space designated by sign for taxicab use.

“Traffic lane” means that area of the roadway used for a single line of traffic movement. (Ord. 2005-09 § 3; Ord. 93-16 § 4; Ord. 88-8 § 3)
