12.15.010 Removal of weeds.

The owner, owners, agent or occupant of any real property within the corporate limits of the City of Monmouth, Oregon, be and they are hereby required to cut and remove the grass, weeds, thistles, brush and vines of all description growing in the streets and alleys adjacent to his or their premises, between the first day of June and the fifteenth day of June of each and every year hereafter; provided, further, that the owner, owners, agent or occupant of any real property within the corporate limits of the City of Monmouth, Oregon, be and they are hereby required to cut and remove the grass, weeds, thistles, vines and brush of all descriptions growing in the fifteenth day of June each year, within five days of the date of the Chief of Police’s notice either verbal or written requiring the same. 12.15.020 Exemption.

No owner or owners or agent or occupant of any such real property within the corporate limits of said City shall be required to cut and remove the grass, weeds, vines, thistles and brush growing in the streets and alleys of said City and adjacent to their respective premises to exceed twice in any one year, provided the same shall be cut and removed at the time hereinbefore provided. 12.15.030 Penalties.

Any owner, agent or occupant of real property within the corporate limits of the City of Monmouth, Oregon, violating any of the provisions of MCC 12.15.010 shall, upon conviction thereof, be fined not more than $250.00. Each day a violation continues shall be considered a separate offense. (Ord. 296, § 2; amended by Ord. 1046, § 1, Dec. 10, 1991. Code 1983 § 31.195.)

12.15.040 Monuments for streets survey.

The four monuments fixed by the survey of D. L. Stanley of April 1881, and referred to upon the plot of the City of Monmouth by said survey are severally and collectively declared to be the base from which to determine any lot, street or public ground as the case may be in the Town of Monmouth. 12.15.050 Infringement upon streets.

Any person infringing upon any street or public ground within the corporate limits of the City of Monmouth, Oregon, by erecting thereon any fence, building or other structure shall be guilty of committing a nuisance and the same shall be abated and the party guilty of such offense shall be punished by a fine of not to exceed $250.00. 12.15.060 Unlawful action.

It shall be unlawful for any person to allow dirt, rock, debris, building materials or landscaping materials to accumulate upon the streets of the City of Monmouth. (Ord. 825, § 1. Code 1983 § 31.230.)

12.15.070 Responsibility.

If dirt, rock, debris, building materials or landscaping materials accumulate upon a City street, the person causing the accumulation to occur shall be responsible for the removal of the accumulation. The accumulation shall be removed before 5:00 p.m. of the day of accumulation. (Ord. 825, § 2. Code 1983 § 31.235.)

12.15.080 Rates.

Accumulations of dirt, rock, debris, building materials or landscaping materials in City streets which remain in the street after 5:00 p.m. on the day of accumulation may be removed by the City. Cost of removal of accumulations by the City shall be charged to the person causing the accumulation at the following rates:

Use of vacuum sweeper

$50.00 per hour

Use of street flusher

$30.00 per hour

Equipment operator

at actual cost for salaries, benefits, overtime charges, etc.

Supervision

at actual cost for salaries, benefits, overtime charges, etc.

Overhead

10%

12.15.090 Occupancy permit.

The City shall refuse to issue an occupancy permit for a building to any person who has failed to pay charges incurred under MCC 12.15.080 incidental to the construction of the building for which the occupancy permit is sought. (Ord. 825, § 4. Code 1983 § 31.245.)

12.15.100 Public nuisance.

Continual accumulation of dirt, rock, debris, building materials, or landscaping materials upon streets shall constitute public nuisance under MCC 8.05.170 and shall be subject to abatement as set forth in MCC 8.05.180 to 8.05.220. (Ord. 825, § 5. Code 1983 § 31.250.)
