2.90.010 Purpose.

The purpose of this chapter is to provide a procedure to minimize injury to persons, property, and/or the environment if a state of emergency exists within city. [Ord. 483 § 2, 2017].

2.90.020 Emergency definition.

In addition to the conditions set forth in ORS 401.025(4), an emergency exists when it is reasonably determined that a potential or actual manmade or natural event, including, without limitation, natural disaster, accident, act of war or terrorism, disease, civil disorder, disruption of community services, and/or other catastrophe or ongoing occurrence, threatens the health, safety, and/or welfare of city and/or its citizens and/or causes or may cause damage, injury, and/or death to persons and/or property in city. 2.90.030 Declaration of emergency.

(1) Declaration of State of Emergency. A state of emergency within city may be declared in accordance with the procedures contained in this chapter. A state of emergency may be declared by (a) the mayor, (b) the council president when the mayor is absent or otherwise unable to perform the functions of mayor, and/or (c) the city manager provided the city manager exercises reasonable efforts to confer with the mayor (or council president if the mayor is absent or otherwise unable to perform the functions of mayor) prior to the city manager’s declaration. Council will ratify the emergency declaration by resolution at the first available opportunity. The mayor, council president, and/or city manager may consult with the building official, fire marshal, public health officer, sheriff, and/or other qualified authority when determining whether a state of emergency exists.

(2) Contents of Declaration. A declaration of a state of emergency must be in writing and include, without limitation, the following information: (a) the nature of the emergency; (b) the geographic boundaries of the area subject to emergency controls; (c) the duration of the emergency declaration; and (d) any special procedures and/or emergency powers adopted as a result of the emergency (which procedures and powers are further described in SMC 2.90.040(1)). City will give notice of the declaration through such public media as the city manager deems reasonable under the circumstances. For purposes of this subsection (2), “public media” includes, without limitation, radio, newspaper, city’s website, and/or other available media sources to city.

(3) Duration of Emergency Regulations. The declaration of a state of emergency (and any special regulations and/or emergency powers adopted in response thereof) will become effective on its issuance. The state of emergency will terminate on the date specified in the declaration, or on the issuance of a proclamation declaring that the emergency no longer exists, whichever is earlier; provided, however, city may extend a state of emergency by issuing a declaration of emergency in accordance with subsection (2) of this section. 2.90.040 Powers – Regulations – City services.

(1) Powers – Regulations. To the fullest extent permitted under applicable law, in connection with a state of emergency declaration made in accordance with SMC 2.90.030, city may adopt procedures to prevent, prepare for, minimize, respond to, and/or recover from an emergency. Such procedures may include, without limitation, the following: (a) suspend standard procurement procedures to expeditiously obtain goods, services, and/or equipment necessary or appropriate to respond to the emergency; (b) redirect and/or use any available city funds for emergency purposes; (c) restrict, regulate, and/or prohibit vehicular and/or pedestrian traffic for such distance(s) and/or degree(s) as may be deemed necessary under the circumstances; (d) enter or pass through private property for the purpose of responding to the emergency and/or damage assessment; (e) establish a curfew during specified hours in specified locations; (f) order and/or assist the evacuation of persons and/or property; (g) turn off (or cause to be turned off) utilities, including, without limitation, water, gas, fuel, and/or electricity; (h) control, restrict, and/or regulate the sale of goods and services; (i) prohibit the sale and/or possession of any weapons and/or explosives in public places; (j) implement mutual aid agreements; (k) grant temporary exemptions from applicable Sisters Municipal Code provisions for emergency shelters; and/or (l) such other measures and/or actions necessary for the protection of the health, safety, and/or welfare of persons, property, infrastructure, and/or the environment.

(2) City Services. Upon the occurrence of an emergency, city will continue to provide city services to the extent reasonably practical under the circumstances. [Ord. 483 § 5, 2017].

2.90.050 Responsibility of city manager.

The city manager (or his or her designee) will oversee city’s emergency management program and administer any emergency duties, regulations, and/or functions prescribed in the state of emergency declaration. [Ord. 483 § 6, 2017].

2.90.060 Ratification.

All acts previously taken by the city manager concerning the city manager’s declaration of a state of emergency and authorization of emergency cold weather shelter facilities in anticipation of severe weather conditions during the winter of 2017-2018 are approved, ratified, and confirmed.
