10.35.010 Bicycle, scooter and skateboard operating rules.

(1) Incorporation of Oregon Law. The provisions of ORS Chapters 811 and 814 are incorporated herein and are adopted by the city of Sisters.

(2) Application of Oregon Law to Bicycles, Scooters and Skateboards. Every person operating a bicycle, scooter or skateboard upon a public roadway within the city of Sisters is subject to the provisions of ORS Chapters 811 and 814 and has the same rights and duties as the driver of any other vehicle operated thereon, except:

(a) Those provisions which by their very nature can have no application.

(b) When otherwise specifically provided under ORS Chapters 811 and 814.

(3) Definitions.

(a) Subject to the provisions of subsection (2) of this section, a bicycle, scooter or skateboard is a vehicle and when the term “vehicle” is used in ORS Chapter 811, it shall be deemed applicable to bicycles, scooters or skateboards.

(b) Subject to the provisions of subsection (2) of this section, when the term “bicycle” is used in ORS Chapter 814, it shall be deemed applicable to scooters and skateboards. [Ord. 198 § 1, 1987; Ord. 89 § 24, 1976. Code 2002 § 10.28.010].

10.35.020 Impounding of bicycles, scooters and skateboards.

(1) Except as provided in SMC 10.35.010, no person shall leave a bicycle, scooter or skateboard on public or private property without the consent of the person in charge or the owner thereof.

(2) A bicycle, scooter or skateboard left on public property for a period in excess of 24 hours may be impounded by the police department.

(3) In addition to any citation issued, a bicycle, scooter or skateboard parked or used in violation of this chapter may be immediately impounded by the police department.

(4) If a bicycle, scooter or skateboard impounded under this chapter is licensed, or other means of determining its ownership exists, the police department shall make reasonable efforts to notify the owner. No impounding fee shall be charged to the owner of a stolen bicycle, scooter or skateboard which has been impounded.

(5) A bicycle, scooter, or skateboard impounded under this chapter which remains unclaimed shall be disposed of in accordance with the city’s procedure for disposal of abandoned or lost personal property.

(6) Except as provided in subsection (4) of this section, a fee of $10.00 shall be charged to the owner of a bicycle, scooter or skateboard impounded under this section. [Ord. 198 § 2, 1987; Ord. 89 § 25, 1976. Code 2002 § 10.28.020].

10.35.030 Sidewalks.

Except as otherwise provided, a person shall not ride or operate a bicycle, scooter, skateboard, or any motorized vehicle or transportation device upon a public sidewalk within the city. A child age 14 or under and any adults accompanying the child may ride nonmotorized bicycles, scooters or skateboards on the sidewalks outside of that portion of the downtown commercial district consisting of the area between and including the south side of Hood Avenue to the north side of Main Avenue and between and including the west side of Pine Street to the east side of Larch Street. This code section does not apply to self-propelled or motorized devices that are medically necessary for the mobility of the person.

No person shall ride a bicycle, scooter, or skateboard upon a public sidewalk within the confines of the city of Sisters. This section shall not apply to members of the Sisters police department while those officers are operating their bicycles while in pursuit or while they are responding to an existing emergency, pursuant to police department policy.
