5.15.010 Definition.

For the purpose of this chapter, “garage sale” shall mean general sales open to the public which are conducted from or on residential premises within a residential district for the purpose of disposing of personal property, commonly known as garage sale, but also known as moving, lawn, attic, porch, backyard, patio or basement sales. 5.15.020 Regulation of garage sales.

No person shall:

(1) Conduct a garage sale exceeding three days in duration or any time other than during daylight hours;

(2) Participate in more than four garage sales in any one calendar year. (Ord. 327 § 2, 1991)

5.15.030 Exceptions.

Notwithstanding the above, the provisions of this chapter shall not apply to the following persons or sales:

(1) Sales pursuant to a duly authorized home occupation or a valid city business license;

(2) Sales commonly referred to as rummage sales, conducted by members of fraternal, civic, patriotic, religious, service, charitable, educational, or eleemosynary organizations with a chapter, lodge, post, congregation or other unit existing within the city;

(3) Sales of one item by public display with a sign indicating the item is for sale and the sale of more than one item so long as the item is not offered for sale by public display or signs concerning their sale or place of sale. (Ord. 327 § 3, 1991)

5.15.040 Advertising signs.

Only the following specified signs may be displayed in relation to a pending garage sale:

(1) Two signs of not more than six square feet shall be permitted to be displayed on the property of the residence or location where the garage sale is being conducted.

(2) Two signs of not more than three square feet each are permitted, provided written permission to erect said signs is received from the property owners upon whose property such signs are to be placed.

(3) None of the aforementioned signs shall be placed in any public right-of-way.

(4) No sign or other form of advertising shall be exhibited for more than two days prior to the day such sale is to commence.

(5) All signs must be removed within 24 hours of the termination of such garage sale. (Ord. 327 § 4, 1991)

5.15.050 Violation – Penalty.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be deemed guilty of a violation and shall be fined an amount not to exceed $500.00. (Ord. 486 § 6, 2009; Ord. 327 § 5, 1991)
