8.10.010 Burn permit required – Fee.

It shall be unlawful to kindle or ignite a fire for the burning of weeds or residential waste in residential areas of the city, unless a burn permit is first obtained from the Eagle Mountain City fire department official authorized to issue such permits. An applicant for a burn permit shall pay a fee for the permit established in the Eagle Mountain City consolidated fee schedule prior to the issuance of the burn permit. [Ord. O-34-2006 § 1].

8.10.020 Distance restriction.

Permits shall only be issued for the burning of combustibles at a distance of at least 50 feet from other combustible materials. [Ord. O-34-2006 § 2].

8.10.030 Fire extinguishing – Generally.

The permit holder must have the ability to extinguish the fire at any time and all fires shall be completely extinguished before abandoning the area of the burn. [Ord. O-34-2006 § 3].

8.10.040 Supervision.

The burning shall be attended at all times by a competent person in control of equipment sufficient to extinguish the fire. [Ord. O-34-2006 § 4].

8.10.050 Legal control of property.

The applicant shall have legal control of the property which is the site of the burn prior to beginning the burn authorized by the permit. [Ord. O-34-2006 § 5].

8.10.060 Fire extinguishing – Deadline.

All fires permitted under an Eagle Mountain City burn permit shall be extinguished completely before dark. [Ord. O-34-2006 § 6].

8.10.070 Containment.

No burns shall pose a threat to property of others, forest range, or watershed lands. Any person responsible for the failure to contain a permitted fire and for the spread of fire necessitating suppression of a fire out of control shall be liable for the payment of all costs of suppression and damage and indemnification to all persons harmed by the nonpermitted fire. 8.10.080 Liability.

A burn permit issued under the provisions of this chapter shall not relieve the individual, applicant, or person in control of the fire from personal liability to intentional acts, neglect or incompetence. [Ord. O-34-2006 § 8].

8.10.090 Exemptions.

This chapter shall not apply to fires kindled for recreational purposes in contained areas or cooking fires in approved containers. [Ord. O-34-2006 § 9].

8.10.100 Weeds.1

A burn permit is not required for the burning of weeds accumulating on agricultural cultivated lands, canals, or irrigation ditches if the burning does not pose a threat to adjoining properties, due care is used in the control of the burning and the individual conducting the burn notifies the Eagle Mountain City fire department of the approximate time the burn will initiate and be extinguished. 8.10.110 Violation – Penalty.

It is a misdemeanor punishable by a fine of up to $1,000 and imprisonment for a period of up to six months to ignite or maintain a fire without securing the permit required by this chapter. [Ord. O-34-2006 § 11].
