12.25.010 Generally.

Citizens, business organizations, and citizens’ groups, which are referred to in this chapter as “participant groups” or “groups,” interested in assuming responsibility for litter, garbage and debris removal from streets or other public property in Eagle Mountain City may apply to the city for permission to adopt a specific street segment, trail, open space, or other public property for litter removal activities under the terms of this chapter. 12.25.020 Application.

Each group interested in adopting a street, trail, or other public property under the terms of this chapter shall make application to the city on a form to be provided by the city and execute the agreement provided by the city to assure compliance with the standards and program requirements defined in this chapter. 12.25.030 Eligible streets.

Streets eligible for program participation under this chapter shall be street segments of a minimum two miles in length with a right-of-way width determined to be adequate by the city engineer for the activity of the group defined in this chapter. [Ord. 00-09 § 3].

12.25.040 Site evaluation by city engineer.

Upon receipt of an application from a citizens’ group proposing adoption of a specific street segment, public trail, open space, or other public property, the city engineer shall evaluate the proposed site and determine whether or not the site is suitable for the citizen activities proposed in the application. The city engineer shall report to the city manager with a recommendation to accept or deny the application. [Ord. O-21-2024 § 2 (Exh A); Ord. 00-09 § 4].

12.25.050 Agreement – Standards.

Each adopt-a-street, trail, open space or park application accepted by the city will be considered by the city council, and if approved, an agreement shall be executed between Eagle Mountain City and the participant group. Each agreement shall require compliance with the following standards for participation in the program:

A. All group participants must be 11 years of age or older.

B. Adult supervision shall be provided for groups which include participants 15 years of age or younger at a ratio of one adult for every five non-adults under the age of 15 years.

C. Group participants must stay off the traveled area of each street.

D. Litter pickup will be active only during daylight hours.

E. Traveled street areas may be crossed by the group under the supervision of the group supervisor and with proper flagging and traffic control.

F. Litter shall be picked up a minimum of three times a year on each adopt-a-street segment, trail, open space, or park. The city may designate one litter pickup day as part of a statewide litter pickup program; provided, however, that the city will provide at least 30 days’ notice prior to the designated statewide litter pickup day.

G. The group shall place filled trash bags at the edge of the shoulder of the adopted street segment or other site designated by the city as they become filled for pickup and disposal by the city at the next work day. All bags are to be tied and torn bags are to be placed inside another bag and tied.

H. All participants must execute an acceptance of risk, indemnification and liability waiver on a form approved by the city. [Ord. 00-09 § 5].

12.25.060 Signs.

The city shall be responsible for placement of appropriate work zone signing and temporary traffic control signs. The city may erect a sign at each end of the adopted section of the street, trail, or other site selected by the city, with the name of the group adopting the street, trail, open space, or park for litter pickup activities. 12.25.070 Responsibilities of city and participant group – Generally.

The city will provide orange safety vests, trash bags, and require a safety meeting for group participants prior to each pickup activity. Litter pickup on the adopted sections of the street shall be the sole responsibility of the adopting group except under circumstances where large, heavy or hazardous items may make litter pickup impractical. 12.25.080 Parking of participant group vehicles during cleanup.

During pickup activities on streets, the participant group shall park all vehicles clear of the roadway, shall face oncoming traffic during all pickup activities and shall not work in inclement weather where visibility or traffic stopping distance may be impaired by weather conditions. 12.25.090 Cleanup area restrictions and limitations.

A. Participants will stay clear of construction activities and shall not enter the roadway or shoulder to pick up litter.

B. The group shall not be responsible to pick up litter on traffic medians or traffic islands and roundabouts. [Ord. 00-09 §§ 9, 10].
