13.20.010 Protection required.

No water service connection to any premises receiving culinary water from the Manila water supply shall be installed or maintained unless the water supply in the premises is protected as required by this chapter. [Ord. 3-8-07.]

13.20.020 Definitions.

“Backflow” means the reversal of the normal flow of water caused by either back-pressure or back-siphonage.

“Back-pressure” means the flow of water or other liquids, mixtures or substances under pressure into the feeding distribution pipes of a potable water supply system from any other source than the intended source.

“Back-siphonage” means the flow of water or other liquids or substances into the distribution pipes of a potable water supply from any source other than the intended source caused by the reduction of pressure in the potable water supply system.

“Cross-connection” means any connection which may allow nonpotable water or industrial fluids or any other material of questionable quality to come into contact with potable water inside a distribution system, including any temporary connections, swing connections, removable connections, four-way plug valves, swivel change-over devices or other similar plumbing arrangements.

“Flow prevention assembly” means an assembly designed to prevent backflow. Refer to Appendix J, Chapter 10, of the Utah Plumbing Code for specifications of such assemblies. [Ord. 3-8-07 § A.]

13.20.030 Duty to inspect.

It shall be the responsibility of the water consumer to purchase, install, test and maintain backflow prevention devices where necessary and to control cross-connections. The consumer shall have certified inspections and operational tests upon request of Manila. When Manila deems a hazard to be great, the consumer may be required to have such inspections as prescribed or required. All such tests shall be made according to the standard set forth by the Utah Department of Health. [Ord. 3-8-07 § B.]

13.20.040 New construction.

The building official of Manila will review all plans for new construction and ensure that unprotected cross-connections are not an integral part of the consumer’s water system. If a cross-connection cannot be eliminated, protection will be required by installation of an air gap or other approved backflow prevention device in accordance with the Utah Plumbing Code. Water vacating the drinking water supply must do so by means of an approved air gap or mechanical backflow prevention assembly as required by code. [Ord. 3-8-07 § C.]

13.20.050 Installation required.

Whenever Manila deems that a water service connection contributes a sufficient hazard to the water supply, installation of an approved backflow prevention assembly shall be required on the lateral service line of the consumer’s water system near the property line, or immediately inside the building being served, but before the first branch line leading off the water line. [Ord. 3-8-07 § D.]

13.20.060 Existing equipment.

All backflow prevention assemblies existing at the time of the adoption of this chapter which do not meet the requirements hereof shall be excluded from the requirements hereof, provided they were approved at the time of installation and have been properly maintained. Such previously existing assemblies shall be subject to the inspection and testing requirements of MMC 13.20.030. Whenever an existing assembly is moved to another location, or when such an assembly has been determined to constitute a health hazard, the assembly shall be replaced by an approved backflow prevention assembly. 13.20.070 Repair and maintenance of equipment.

The maintenance of all backflow prevention assemblies and cross-connection control devices required by this chapter shall be the responsibility of the consumer, and failure to adequately maintain the required equipment shall be a violation of this chapter. All installations and repairs of such equipment shall be effected by a certified backflow technician as required by MMC 13.20.090. [Ord. 3-8-07 § F.]

13.20.080 Access for inspection.

A consumer system shall be open for inspection at reasonable times to an authorized representative of Manila in order to determine if cross-connections or other hazards exist. A consumer of the Manila water system shall be responsible to provide access across their property for inspection purposes free from litter, overgrowth, threat of vicious animals, or any other hindrance that may be detrimental to ease of access. 13.20.090 Certified backflow technician.

All tests of mechanical devices shall be conducted by a certified backflow technician. Such a technician shall be responsible for the following:

A.    Assure that acceptable testing equipment and procedures are used for the testing, repairing or overhauling of the backflow assemblies.

B.    Make reports of such testing and/or repairs to the consumer and to the Manila water system administration.

C.    Include a list of all material and replacement parts used.

D.    Assure that replacement parts are equal in quality to the original parts and that any testing, change or repair does not alter the design of operational characteristics of the assembly. [Ord. 3-8-07 § H.]

13.20.100 Public notification.

Although failure of a Manila water system consumer to be aware of this chapter shall not be a defense to violation, the Manila water department shall use reasonable means to notify consumers of the hazards of cross-connections and the need for regular inspections of backflow assemblies. [Ord. 3-8-07 § I.]

13.20.110 Records.

The Manila water department shall keep responsible records of cross-connection hazards and the condition of backflow assemblies, including those required by state and federal agencies. [Ord. 3-8-07 § J.]

13.20.120 Violations.

Service of a Manila water consumer found to be in violation of this chapter shall be discontinued after written notice of the violation, and failure to correct the violation within 10 days after written notice. A violation exists under the following parameters:

A.    If the backflow prevention assembly required for control of cross-connections is not installed, tested or maintained.

B.    The backflow prevention assembly has been removed or bypassed.

C.    An unprotected water system cross-connection exists on the premises in violation of this chapter.

D.    A required inspection is not done as provided by ordinance. [Ord. 3-8-07 § K.]

13.20.130 Repeal of ordinance sections.

This chapter’s provisions and modifications to existing ordinances shall take effect immediately following its adoption by the Manila council and signed by the mayor. All existing sections that regulate cross-connections, backflow assemblies, and their relationship to the protection of the Manila water system are repealed to read as set forth in this chapter as adopted by the Manila council. 13.20.140 Due process.

Before any water service is terminated, due process will provide for written notice to the water service customer and a reasonable time for correction. An emergency situation shall necessitate the immediate termination of the connection until the danger to the public ceases. The consumer is required by this chapter to make the necessary correction, and have the prescribed testing and inspection constituting a corrective action within 10 days. Failure to comply will result in discontinuance of water service to the premises found in violation. Such water service will only be restored upon proof of defect or conditions corrected that constituted a violation of this chapter. [Ord. 3-8-07.]
