PUBLIC FACILITIES RENTAL REGULATIONS

12.06.010 Establishment.

There is hereby established a rental policy for the facilities provided by the City of Airway Heights Parks and Recreation Department. (Ord. C-920 § 3, 2019)

12.06.020 Recreation center banquet room, meeting room, party rooms, and kitchen facilities.

A. Permitted Uses. The rooms at the recreation center shall be open for uses which are compatible with the nature of the facility. These uses include but are not limited to:

1. Seminar, program, club or association meetings;

2. Passive educational or passive instructional classes;

3. Political party meetings;

4. Fundraising events sponsored by nonprofit organizations in operation for at least one year. Proof of nonprofit status may be requested before approval.

5. Any use not listed herein is subject to consideration by the City. The City reserves the right to reject any request to use the rooms if such use is not compatible with the nature of the facility.

B. Nonpermitted Uses. The following uses will not be permitted:

1. Any activity involving the use of flammable materials or explosives;

2. Fundraising events sponsored by any for-profit organization.

C. Scheduling. City staff shall develop general hours during which the facility rooms shall be open for use. Staff shall also make available an application form for use of the facility.

1. All uses are subject to cancellation at any time, if the City deems it necessary for the City to use the space during any time period.

2. No person shall be permitted to use the facility without first obtaining City approval.

3. City staff reserves the right to limit the use of any single group if that use restricts the availability of the facility for other groups.

D. User Fees. All nonmunicipal users shall pay a fee and post a deposit in an amount to be set by resolution of the City of Airway Heights City Council. Payment of required fees and security deposit shall accompany submission of the permit application.

E. User Responsibilities.

1. It shall be the responsibility of the user of the facility to conduct their activities in a manner that does not interfere with use of other sections of the building by other persons.

2. It shall also be the user’s responsibility to clean the premises upon the conclusion of their meeting. The City reserves the right to deny use privileges to any group that fails to meet these responsibilities. The City shall retain so much of the security deposit as is necessary to cover any costs to the City for repairing or cleaning the premises. The user shall remain liable for any costs incurred by the City for cleaning and repair beyond the deposit amount.

F. Rules.

1. Tobacco use including smoking, chewing and vaping is prohibited within the interior of the facility and within 25 feet of the facility.

2. Alcohol possession and consumption are prohibited within the facility.

3. Maximum occupancy as posted shall not be violated.

4. If state or county permits are required for service and preparation of food and/or beverages, they must be obtained and confirmed with the City prior to facility use.

5. The City reserves the right to institute additional rules regarding the use of the facility. Failure to observe the use rules for the facility may result in denial of future use or the requirement for additional damage deposits prior to allowing future use. (Ord. C-931 § 1, 2019; Ord. 12.06.030 Reservations for park use.

A. Use. Portions of the City of Airway Heights park system are available for reserved use for specified periods of time. Those areas include but may not be limited to softball/baseball fields, picnic areas and shelters, volleyball courts, and multi-purpose field space. Any person over the age of 18 may reserve a portion of the City parks for private use at such times and upon such terms as authorized by the Parks and Recreation Department staff.

12.06.040 Application process.

A. An application is required for all actions administered by this chapter.

B. All applications for public facilities rental administered by this chapter shall be submitted on forms provided by the City of Airway Heights Parks and Recreation Department. All applications shall be signed and acknowledged by the applicant. The City reserves the right to deny an application.

C. An application shall be determined to be complete upon the applicant’s submittal of an application, the payment of the rental fee and deposit. A deposit or a portion thereof will be released upon verification by the City that no damage has occurred to the property. (Ord. C-920 § 6, 2019)
