13.06A.010 Adoption by reference of Spokane Municipal Code Chapter 13.03A.

The City hereby adopts by reference Chapter 13.03A of the City of Spokane Municipal Code as the wastewater pretreatment control regulations for the City of Airway Heights, as now in effect and as subsequently amended by both the City of Spokane and City of Airway Heights. All references to “City” in Chapter 13.03A of the City of Spokane Municipal Code shall be construed to refer to the City of Airway Heights.

Where terms in either Chapter 13.06 AHMC or City of Spokane Chapter 13.03 are inconsistent with the intent and purposes of state and federal permits for operation of the water reclamation plant, such words, terms, phrases and understandings shall be interpreted to comply with state and federal permits, laws and regulations related to the City of Airway Heights. 13.06A.0101 Amendment of Section 13.03A.0101.

Section 13.03A.0101 entitled “Purpose and Objectives” of the City of Spokane Municipal Code is hereby amended to add a new subsection B(8) as follows:

(8) Comply with the terms and conditions set forth in the Interlocal Agreement – Airway Heights Pretreatment by and between the City of Spokane and the City of Airway Heights dated February 3, 2012.

13.06A.0106 Amendment of Section 13.03A.0106.

Section 13.03A.0106 of the City of Spokane Municipal Code entitled “Legislative History” is amended by deleting subsection “A” and adding the following:

13.03A.0106

A. Adoption of this pretreatment ordinance as approved by state and federal authorities is a requirement for the City to comply with its Reclaimed Water and NPDES permits as well as the Interlocal Agreement – Airway Heights Pretreatment Program Existing by and between the City of Spokane and the City of Airway Heights. Additional requirements related to the City sanitary sewer system are found in Airway Heights Municipal Code Chapter 13.06, which contains general provisions, definitions, reporting requirements, administrative provisions, and other matters relating to the construction, use and operation of the City sanitary sewer system. The pretreatment provisions of Chapter 13.06 have been removed and recodified in Airway Heights Municipal Code Chapter 13.06A following construction of the Water Reclamation Plant.

13.06A.0204 Local limits.

A. The following limits are established as local limits, expressed as maximum daily discharge limits. No significant industrial user may discharge wastewater into the POTW in excess of the following concentrations:

1. Arsenic: 0.01 mg/L;

2. Barium: 1.0 mg/1;

3. Beryllium: 0.004 mg/L;

4. Cadmium: 0.01 mg/L;

5. Chromium: 0.05 mg/L;

6. Chloride: 250 mg/L;

7. Copper: 1.0 mg/L;

8. Cyanide: 0.2 mg/L;

9. Fluoride: 4 mg/L;

10. Iron: 0.30 mg/L;

11. Lead: 0.05 mg/L;

12. Manganese: 0.05 mg/L;

13. Mercury: 0.002 mg/L;

14. Nitrate-N: 50 mg/L;

15. Nitrogen, total: 50 mg/L;

16. Selenium: 0.01 mg/L;

17. Silver: 0.05 mg/L;

18. Sulfate: 250 mg/L;

19. Sulfides, dissolved: 0.5 mg/L;

20. Total dissolved solids: 500 mg/L;

21. Zinc: 5.0 mg/L;

22. Bis(2-ethylhexyl) phthalate: 0.006 mg/L;

23. Oil and grease (n-hexane extractable material (HEM): 100 mg/L;

24. Non-polar oil and grease (silica gel treated n-hexane extractable material (SGT-HEM): 50 mg/L; and

25. pH: Less than 5.0 S.U. or greater than 12.0 S.U. (Ord. C-997 § 2, 2022; Ord. C-794 § 8, 2013)

13.06A.1401 Amendment of Section 13.03A.1401.

Section 13.03A.1401 entitled “Pretreatment Fees” of the City of Spokane Ordinance is hereby amended by deleting section “C” in its entirety and substituting the following:

13.03A.1401C

The City of Airway Heights City Council shall, through resolution, establish the permit application fee (see SMC 13.03A.0304F), annual inspection fee (see SMC 13.03A.0307(A)(2)), permit renewal application fee (see SMC 13.03A.0313), administrative appeal fee (see SMC 13.03A.0904(A)), fees for publication of significant non-compliance notice with requirement that payment be made in advance (see SMC 13.03.A.0801), monitoring, inspection, surveillance, sampling and processing fees, administrative penalty, hourly costs for staff and consultants, plus such other fees as are reasonably necessary in order to implement the City Wastewater Pretreatment Control Regulations.
