17.33.010 Purpose.

The purpose of this chapter is to provide for reduced parking requirements and increased lot coverage, allowing a higher percentage of square footage for lease and increasing development intensity. This center would also emphasize mixed residential and commercial uses, introducing attached housing in the central business district and encourage walkability. (Ord. C-675 § 394, 2008)

17.33.020 Areas where permitted.

The Village Square overlay encompasses U.S. Highway 2 to the north, 17th Avenue to the south, Lundstrom Street to the west and Lawson Street to the east. (Ord. C-675 § 395, 2008)

17.33.030 Prohibited uses.

Any use not listed under the permitted uses in the underlying zone or accessory uses is prohibited in an overlay district unless authorized in the zoning matrix. (Ord. C-675 § 396, 2008)

17.33.040 Conditional use criteria – Village Square.

The following criteria shall be met for conditionally allowed uses in the district:

A. The proposed use shall support the goals, policies and objectives of the Airway Heights Comprehensive Plan.

B. The proposed use shall promote a pedestrian orientation, and require sidewalks per the Public Works Standards Manual.

C. The proposed use shall include a landscape plan that fulfills the requirements established in Chapter 17.22 AHMC. (Ord. C-675 § 397, 2008)

17.33.050 Performance standards.

A. Expansion of Specified Existing Uses. Existing residential dwellings lawfully constructed as of the effective date of the ordinance codified in this title may be maintained as follows:

1. The specified uses may expand up to 25 percent of their square footage, except that expansion shall not occur if it is necessary to purchase additional property. The expansion shall meet the development standards of the zone such as setbacks, lot coverage and building height;

2. No additional dwelling units may be added, except that existing single-family dwellings may add an accessory dwelling unit;

3. Structures may be rebuilt after a fire or other disaster to original dimensions unless a health or safety impact would occur. (Ord. C-675 § 398, 2008)

17.33.060 Minimum yards.

A. Minimum setback requirements from lot lines are as follows:

1. Front yard – At property line, up to 25 feet;

2. Rear yard – 10 feet;

3. Side yard – zero feet;

4. Corner yard – 15 feet (five feet for those structures outside of the clear-view triangle).

B. The Technical Review Committee may alter these setback guidelines if a design is proposed that differs from these standards, but still provides the same level of safety and aesthetics as intended by these setbacks. (Ord. C-675 § 399, 2008)

17.33.070 Parking standards.

A. Central parking areas are encouraged and should be no farther than 20 feet from the business.

B. If parking is located near the business it must be in the back, as should the loading area. (Ord. C-675 § 400, 2008)

17.33.080 Sign standards.

A. No pole signs are permitted.

B. Monument signs, projected/hanging signs and wall signs are permitted but must remain outside of the City right-of-way. (Ord. C-675 § 401, 2008)

17.33.090 Fence and wall standards.

A. No fences are permitted in the front setback.

B. Fences in the rear setback are permitted. (Ord. C-675 § 402, 2008)

17.33.100 Landscaping standards.

For required landscaping for each development in the Village Square overlay, a landscaping plan shall be prepared to address landscaping of yards and shall be submitted for approval to the Community Development Director or his or her designee. Planters and hanging baskets are encouraged and may be used in lieu of landscaping requirements. (Ord. C-675 § 402, 2008)

17.33.110 Storage standards.

Trash and building mechanical equipment must be screened from public view. (Ord. C-675 § 403, 2008)
