10.30.010 Eligible hunters.

10.30.020 Hunting for ceremonial use – Extreme personal hardship.

The Business Committee may issue “designated hunter” permits to allow wildlife to be bagged for funerals, Tribal ceremonies, and in cases of extreme personal hardship. The permit shall specify the type, sex, and number of animals to be hunted, and any other conditions the Business Committee attaches. Permits under this section may be issued for use during a closed season. The Fish and Wildlife Committee shall recommend to the Business Committee a “designated hunter” to receive the permit. Requests for permits under this section must be submitted in writing to the Fish and Wildlife Committee who shall then submit the request, along with any recommendations it may have, to the Business Committee for action. The writing requirement may be waived for applications to hunt for funeral purposes due to the limited time available. [Res. 2011-020; Res. 2006-63; Res. 1993-1; GC vote 9/12/1989. 10.30.030 Hunting for another.

The Business Committee may issue permits to allow a “designated hunter” to hunt for another member of the Chehalis Tribe. Requests for permits under this section must be submitted in writing to the Fish and Wildlife Committee. The Fish and Wildlife Committee shall make a recommendation to the Business Committee whether the request should be granted. Requests must state the reasons the person or family is/are unable to hunt for himself/themselves. 10.30.040 Designated hunter.

Any member of the Chehalis Tribe possessing a valid Chehalis hunting permit and who meets the following requirements is eligible to serve as a designated hunter:

A. Demonstrated hunting ability;

B. Be an enrolled member of the Chehalis Tribe;

C. Be at least 18 years old;

D. Having no Tribal hunting conviction for the previous two years; and

E. Persons prohibited from carrying a firearm under Tribal, State, or Federal law are not eligible. This section shall not apply to State or Federal hunting convictions where the prosecution was based primarily on the exercise of Tribal hunting rights.

Any person who meets the eligibility requirements may be recommended by the Fish and Wildlife Committee to the Business Committee for appointment as a designated hunter. The Business Committee shall notify the Fish and Wildlife Committee of designated hunter appointments. When the Business Committee grants a request under CTC 10.30.020 or 10.30.030, it shall approve issuance of the appropriate permit and tags to a specific designated hunter.
