16.18.010 Lien authorized.

Chelan County shall have a lien for any civil penalty imposed or for the cost of any work of abatement done pursuant to this title, or both, against the real property on which the civil penalty was imposed or any of the above work was performed. 16.18.020 Filing and contents.

(1)    The administrator shall cause a claim for lien to be filed for record in the Chelan County auditor’s department within ninety days from the date the civil penalty is due or within ninety days from the date of completion of the work or abatement performed pursuant to this title.

(2)    The lien shall contain the following information:

(A)    The Chelan County Code provision;

(B)    A brief description of the violation;

(C)    A brief description of the abatement work done, if any, and who performed the work;

(D)    The owner of the property, if known, or a statement that the owner is not known;

(E)    A description of the property;

(F)    The amount of penalties or costs that are owing; and

(G)    A sworn statement signed by the administrator verifying the claim by oath to the effect that the affiant believes the claim is just. (Res. 2020-137 Att. A, 12/8/20; Res. 2003-67 (part), 5/20/03).

16.18.030 Supplemental lien.

The administrator may record supplemental liens with the Chelan County auditor’s office to update information regarding penalties and costs in an existing lien. (Res. 2020-137 Att. A, 12/8/20; Res. 2003-67 (part), 5/20/03).

16.18.040 Alternative enforcement.

As an alternative to enforcement of any lien created under Section 16.18.010, each lien created may be collected in the following manner:

(1)    By the Chelan County treasurer in the same manner as a delinquent property tax, if within ninety days from the date the owner is sent notice of the lien, including the amount thereof, the lien remains unpaid, and an appeal is not pending pursuant to Chapter 16.12.
