2.32.010 Police department.

The police department of the city of Colfax shall be the law enforcement agency of the jurisdiction.  Its primary function shall be the detection and apprehension of persons committing infractions or violating traffic or criminal laws duly enacted by the city, state and federal governments.  The department shall enforce parking, animal control and nuisance laws and perform such other duties and functions as may be delegated to it by the mayor, city administrator, or the city council consistent with RCW 35.23.010, Title 6, Chapter 8.04, Title 9, and Chapter 15.02.  The police department may consist of any number of sworn police officers and part-time officers as allowed in the annual budget adopted by the city council of Colfax, Washington.  The mayor of the city is authorized to appoint a chief of police. The majority of city council must vote on confirmation of the chief of police within thirty days of appointment by mayor.  (Ord. 16-06 §1).

2.32.020 Special policemen--Appointment.

The mayor may appoint, from time to time, such special policemen as may be necessary to preserve the peace of the city. (Prior code §2.36.020).

2.32.025 Chief of police--Designation as traffic engineer--Generally.

The chief of police of the city of Colfax is hereby designated as the traffic engineer who shall have all the powers and duties as provided in RCW 46.90.260 and 46.90.265 and any other applicable section of the Washington Model Traffic Ordinance as found in Chapter 46.90 RCW; provided, however, that the city council shall retain the power to revoke or amend any decision by the chief of police when acting as the traffic engineer pursuant to RCW 46.90.260 or RCW 46.90.265. (Ord. 1122 §l, 1982).

2.32.026 Chief of police--Designation as traffic engineer--Responsibilities.

Each and every traffic-control device, including but not limited to marks, lines, zones, lanes, signals and limits, as presently exist in the city of Colfax are hereby adopted and ratified by the city of Colfax, as authorized acts, decisions and responsibilities by the traffic engineer after an engineering and traffic investigation, in accordance with Chapter 46.90 RCW. (Ord. 1122 §2, 1982).

2.32.030 Civil service system--Adopted.

The system commonly known as civil service, as set forth in Chapter 41.12 RCW, is adopted for the police department of the city of Colfax, and all full paid employees therein, and all advancements, demotions, suspensions, discharges or control thereof, shall be under the control of and governed by civil service rules prescribed in or adopted pursuant to said Chapter 41.12 RCW as the same may have been heretofore or may be hereafter amended, except as otherwise specifically provided herein. 2.32.040 Civil service commission--Creation--Membership.

There is created for the administration of such civil service for the police department, a civil service commission composed of three members who shall be appointed by the mayor of the city of Colfax. The term of office of such civil service commission shall be six years, except that the first three members of such commission shall be appointed for different terms as follows:  one to serve for a period of two years, one to serve for a period of four years, and one to serve for a period of six years.  In the event any civil service commissioner resigns, becomes disqualified, or is removed for cause, another commissioner shall be appointed to take his place for the unexpired portion of the term.  (Prior code §2.36.040).

2.32.050 Civil service commission--Powers and duties.

The commission shall organize itself, holding meetings, adopt rules and regulations, perform the duties and exercise the powers of the commission in accordance with state law.  (Prior code §2.36.050).

2.32.060 Civil service regulations--Applicant compliance.

All applicants for employment with, advancement in, or the filling of a vacancy in the police department of the city shall be required to have the qualifications, have a tenure of office, and be subject to removal, as provided in the civil service regulations adopted by the commission consistent with state law, except that notwithstanding anything in Chapter 41.12 RCW to the contrary, the following special rules shall apply:

1.  In the employment, advancement and filling of vacancies in the department, the commission shall certify to the appointing power the names of the three persons highest on the eligible list for the class to which the vacant position has been allocated, who are willing to accept employment; and

2.  To enable the appointing power to exercise a choice in the filling of positions, no appointment, employment or promotion in any position in the classified service shall be deemed complete until after the expiration of a period of probationary service of one year; said probationary service for entry-level employees to commence after successful completion of the Washington State Criminal Justice Training Commission Police Academy as required by RCW 43.101.200, during which the appointing power may terminate the employment of the person certified to him, or it, if during the performance test thus afforded, upon observation or consideration of the performance of duty, the appointing power deems him unfit or unsatisfactory for service in the department, whereupon the appointing power shall designate the person certified as standing next highest on any such list and such person shall likewise enter upon said duties until some person is found who is deemed fit for appointment, employment or promotion for the probationary period provided therefor, whereupon the appointment, employment or promotion shall be deemed to be complete.  (Ord. 06-02 §1; Ord. 1177 §1, 1985:  prior code §2.36.060).

2.32.070 Benefits.

All members of the present police department of the city shall be entitled to the benefits accruing under Sections 2.32.030 through 2.32.080 and RCW Chapter 41.12, as amended, including retaining their present positions and ranks without being subject to the examination and investigations to be required for the appointment of all subsequent employees of the police department.    (Prior code §2.36.070).

2.32.080 Part-time employee exception.

Sections 2.32.030 through 2.32.070 shall not apply to part-time employees of the police department. (Prior code §2.36.080).
