13.24.010 Purpose.

The purpose of this chapter is to regulate the discharge of portable toilet waste into the city’s wastewater treatment system.  (Ord. 05-02 §1).

13.24.020 Definitions.

"Portable toilet waste" is typical waste from portable or chemical toilets such as human urine and feces, paper tissue, and preservation or sanitation chemicals, collected for transport and disposal.  (Ord. 05-02 §2).

13.24.030 Permit required.

It shall be unlawful for anyone to dispose of portable toilet waste in the city wastewater sewer system except by permit issued by the public works supervisor or his delegate or, in his absence, by the city administrator or his delegate.  The permit shall be issued in accordance with standards established by the public works supervisor as to origin, volume and type of material to be discharged; provided, discharge to the city wastewater system of nondomestic waste such as from an industrial or commercial facility, an oil/water separator or a grease trap shall be strictly prohibited.  (Ord. 05-02 §3).

13.24.040 Fees.

A fee schedule for disposal of portable toilet waste into the city sewer system shall be established by resolution of the city council.  (Ord. 05-02 §4).

13.24.050 Application form.

An application form for a portable toilet waste discharge permit shall be established by the public works supervisor in accordance with this chapter.  It shall be accompanied by such documentation as may be required by the public works supervisor to verify the type, origin and volume of waste to be discharged.  (Ord. 05-02 §5).

13.24.060 Location of discharge.

Discharge to the city wastewater system shall occur at the city wastewater treatment plant only, unless an express written waiver for disposal at another location is issued prior to the discharge.  (Ord. 05-02 §6).

13.24.070 Sampling--Revocation.

The public works supervisor is hereby authorized to develop a sampling protocol to determine or verify the type and content of waste for which a discharge application has been submitted or for which a permit has been issued.  The public works supervisor may refuse a permit to any person, firm or corporation who has applied for a discharge permit if such waste does not meet the criteria established under this chapter.  The public works supervisor may refuse future permits or revoke any current permit to any person, firm or corporation who has discharged waste to the city wastewater system that does not conform to the provisions of this chapter.  (Ord. 05-02 §7).

13.24.080 Violation.

Any person, firm or corporation violating the provisions of this chapter shall be guilty of a civil infraction, and upon conviction thereof shall be fined not less than two hundred fifty dollars.  Each violation shall constitute a separate offense within the meaning of the ordinance codified in this chapter.  (Ord. 05-02 §8).
