16.16.010 Contents.

The preliminary plat tracings and prints shall have dimensions that are multiples of nine inches along one side and multiples of twelve inches along the adjacent side. Tracings shall be submitted rolled in a mailing tube and prints shall be submitted folded to nine inches by twelve inches. The drawing shall be to a scale of one inch equals one hundred feet. The preliminary plat shall contain the following information:

A.  Name of subdivision;

B.  Legal description of location;

C.  Scale of the layout or plat;

D.  Date;

E.  Basis of bearings;

F.  Boundary lines of the subdivision with length and bearing of lines;

G.  Relationship of the subdivision to section and half-section lines and to any adjacent city boundary lines and distances and bearings to the nearest official monuments;

H.  The location, widths and names of streets or other public ways, easements, railroad and utility rights-of-way both within the subdivision and-those adjacent to or leading into the subdivision;

I.  Proposed methods of providing for stormwater disposal, sanitary sewage disposal and water supply;

J.  Location of land intended to be dedicated to public use or reserved in the deeds for the use of all property owners in the subdivision;

K.  Numbers and dimensions of lots and blocks;

L.  Location of watercourses and other important features;

M.  Contours, with intervals of five feet or less, referred to sea level datum;

N.  Names and addresses of owner and subdivider and land surveyor or engineer who designed the preliminary plat;

O.  The names of immediately adjacent subdivisions and the names of owners of record of adjacent unsubdivided tracts;

P.  Existing permanent buildings or structures within or adjacent to the tract; and

Q.  Where the preliminary plat covers only a part of the subdivider’s entire holding, a sketch of the prospective street system of the part not submitted must be furnished, and the street system of the submitted part will be considered in the light of adjustments and connections with the street system of the part not submitted. 16.16.020 Required.

Prior to the completion of the final survey of streets and lots of any subdivision and before any map of the subdivision is made in form suitable for recording, a preliminary plat, prepared in accordance with the regulations set forth herein, shall be submitted to the planning commission for its review and recommendations. (Ord. 1161 §1(part), 1984).

16.16.030 Application for conditional approval.

A written application, in quadruplicate, for the conditional approval of the subdivision, together with ten prints of the preliminary plat shall be filed with the city clerk at least 14 days prior to the scheduled meeting of the commission in order to receive action at such meeting. Upon receipt of the application, the city clerk shall forthwith forward it to the planning commission.

The planning commission shall determine whether the preliminary plat is in proper form and shall not receive or consider the application as filed until all documents are in accordance with the requirements set forth herein and the proper fee has been paid. (Ord. 1161 §1(part), 1984).

16.16.040 Consideration by planning commission.

A.  Prior to making any determination and recommendation to the city council, the planning commission shall set the date for, and hold, a public hearing on the preliminary plat. Legal notice of such hearing shall be given by publication of at least one notice not less than ten days prior to the hearing in the official newspaper of the city; by posting on the property; and by posting on the official bulletin board of the city. The legal notice shall include a legal description as well as a vicinity location sketch or a location description in nonlegal language. Informal notice shall be mailed to owners of property lying within three hundred feet of the subdivision’s external boundaries.

B.  The planning commission shall study the preliminary plat in connection with the comprehensive plan, including the major street plan, and the topography of the area, and will take into consideration the general requirements of the neighborhood, environmental effects and the best use of the land to be subdivided. Particular attention will be given to specific requirements for streets, drainage facilities, utilities, street connections and suitability of land for development.

C.  When in the considered opinion of the planning commission the preliminary plat does not make adequate provisions for such features, or may be detrimental to the public health, safety and welfare, it shall recommend to the city council that the preliminary plat be disapproved. 16.16.050 Action by planning commission.

The planning commission will communicate its conditional approval or its disapproval in writing to the council within sixty days after the time at which application for conditional approval is made, giving in case of conditional approval the specific changes which it will require in the preliminary plat and the character and extent of the required public improvements. The city council shall schedule and publish notice of a public hearing, at which testimony and evidence shall be received, and the council shall determine to approve or disapprove the preliminary plat. 16.16.060 Action by council.

A representative of the planning commission shall attend the public hearing of the council and be given an opportunity to discuss the preliminary plat and the planning commission’s recommendations. Upon receiving the testimony of the planning commission’s representative and of member of the public, and upon considering the preliminary plat and report thereon, the council shall, by resolution, approve or disapprove the preliminary plat. The city clerk shall mail notice of its adoption to the applicant. The council’s approval or disapproval shall occur within ninety days following filing of the preliminary plat, unless the applicant consents to an extension. The period shall be tolled during the time, if any, required to prepare and process an environmental impact statement. (Ord. 1161 §1(part), 1984).

16.16.070 Conditional approval limitations.

Conditional approval by the council of the preliminary plat does not constitute acceptance if the final plat of the proposed subdivision, acceptance of proposed improvements or final agreement as to improvement specifications or costs. It is to be considered only as approval of the general layout design. (Ord. 1161 §1(part), 1984).

16.16.080 Effective period of conditional approval.

Conditional approval of the preliminary layout shall be effective for a maximum period of twelve months except that submission within this period of a final plat applying to a portion of the area covered by the preliminary layout shall extend the effective period of conditional approval to a maximum of twenty-four months from the date of submission of the preliminary layout. If a final plat has not been submitted to the planning commission within these time limits, the preliminary layout shall again be submitted to the planning commission for conditional approval. 16.16.100 Other charges.

In addition to the minimum fee schedule, the subdivision shall also reimburse the city for identifiable direct costs such as publication costs, long-distance telephone charges, third-party consultation fees and any other expense directly associated with the application. (Ord. 1161 §1(part), 1984).
