8.12.010 Sale – Keeping prohibited.

It shall be unlawful for any person, firm or corporation to display, sell, or keep or offer for sale in the town of Concrete, Washington, any firecracker cannon, cracker, torpedo, bomb, mine, or any similar article or device containing gunpowder, dynamite, or any other explosive substance. 8.12.020 Combustion unlawful.

It shall be unlawful for any person to fire, shoot, or explode any of the fireworks or devices specified in CMC 8.12.010 within the corporate limits of the town of Concrete. [Ord. 87 § 2, 1924]

8.12.030 Penalties.

Any person, firm, or corporation violating the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction of such violation, such person, firm or corporation shall be subject to punishment by a fine of not more than $1,000 or by imprisonment for not more than 90 days, or both such fine and imprisonment. It is unlawful for any person to discharge or use fireworks in a reckless manner which creates a substantial risk of death or serious physical injury to another person or damage to the property of another. A violation of this chapter is a gross misdemeanor. A person is guilty of a separate offense for each day during which he or she commits or continues a violation of any provision of this chapter. 8.12.040 Exceptions.

This chapter shall not apply to the firing of fireworks as part of a public display, where such fireworks display is in the charge of a committee of one or more adults; provided further, that a permit for setting off the fireworks display is first obtained from the town council, setting forth the time, place and any other conditions of the display.
