12.12.010 Permanent obstructions prohibited – Penalty.

A. It is unlawful for any person or persons, without special permission obtained from the city council, to place or keep any obstructions on the sidewalks, streets or alleys of the city, such as fences, porches, buildings, stairways, cellar steps or any other stationary object that may interfere with the full and free use of the sidewalks, streets or alleys of the city by the public as highways.

B. Any person violating this section shall, upon conviction thereof, be guilty of a misdemeanor and subject to the general penalty provisions provided in DPMC 1.16.010. (Ord. 756 § 2, 2001; Ord. 8 § 1, 1908)

12.12.020 Temporary obstructions prohibited – Penalty.

A. It is unlawful for any person to keep or place any obstruction of a temporary character on the sidewalks or in the streets and alleys of the city, such as vehicles, boxes, barrels, cord wood or any other kind of goods or wares, signs and other things that may interfere with the full and free use of the sidewalks, streets or alleys of the city by the public as highways, or which may be dangerous or injurious to any person. This section shall not be construed to prevent merchants or other persons from receiving and passing over the sidewalks, streets and alleys any article or thing which may be necessary for them so that it will be done in a manner that will interfere with the use of sidewalks, streets or alleys as little as reasonably may be; or to use two feet of the sidewalk next to the building for the purpose of displaying goods, wares or merchandise in front of stores and shops.

B. Any person violating this section shall, upon conviction thereof, be guilty of a misdemeanor and subject to the general penalty provisions provided in DPMC 1.16.010. (Ord. 524 § 2, 1986; Ord. 8 § 2, 1908)

12.12.030 Vehicle obstructions prohibited – Penalty.

Any person or corporation having the control or management of any vehicle or vehicles of any kind, traction engine, railroad engine, car or cars, hand car, truck or anything of like nature who allows the same to stand on or across any street, alley, sidewalk or public crossing within the city so as to obstruct the same or in any manner hinder or delay traffic or travel for a period longer than 10 minutes shall, upon conviction thereof, be guilty of a misdemeanor and subject to the general penalty provisions provided in DPMC 1.16.010. 12.12.040 Street obstruction bond.

From and after the effective date of the ordinance codified in this section and DPMC 12.12.050 and 12.12.060, the city shall require that prior to the excavation by any utility company, construction company or individual of any roadway within the city limits, the city treasurer shall be furnished with evidence that the excavation is covered by a street obstruction bond. 12.12.050 Bond amounts.

Evidence of street obstruction bonds shall be furnished in not less than the following amounts:

A. For the excavation of paved roadways:

1. Excavation of 50 square feet or less, $2,000;

2. Excavation of more than 50 square feet but less than 500 square feet, $4,000;

3. Excavation of 500 square feet or more, $6,000.

B. For the excavation of unpaved roadways:

1. Excavation of 50 square feet or less, $1,000;

2. Excavation of more than 50 square feet but less than 500 square feet, $2,000;

3. Excavation of 500 square feet or more, $3,000. (Ord. 389 § 2, 1981)

12.12.060 Period of bond.

The street obstruction bond covering any particular program shall be valid for not less than one year from the date upon which the excavation is completed. (Ord. 389 § 3, 1981)
