ROAD CLOSURES DURING FIRE HAZARD CONDITIONS

12.40.010 Road closure conditions.

Any fire chief, public agency or land owner may request in writing that the county fire marshal find that extreme fire danger conditions exist. The fire marshal may, upon such findings, recommend to the board of county commissioners that all or a portion of a county road be immediately closed to vehicular use. Upon concurrence with the fire marshal, the board of county commissioners shall order the road closure and make the closure signs available to the requesting party.

The closure order prohibits vehicle use on all of the affected portions of the road, except use by those persons who have no alternative access to and from their residences, owned property or leased property, by emergency response vehicles, by law enforcement vehicles and by county road vehicles.

The requesting party shall post and maintain the signs. One notice shall be posted on the road at each point of closure within five days of the order of closure. The notice shall read substantially as follows:

12.40.020 Procedure to rescind road closure.

Upon concurrence with the written notice from the county fire marshal that extreme fire danger conditions no longer exist, the board of county commissioners shall rescind the closure order and direct the county engineer to remove closure signs within three days and provide notice to the affected fire district. 12.40.030 Violation—Penalty.

Any person using a vehicle on a closed county road contrary to DCC Section 12.40.010 shall be subject to a citation for an infraction and a penalty not to exceed two hundred fifty dollars. (Res. TLS 02-36B Exh. A (part): Ord. PW 92-01-15B (part))
