12.36.010 Purpose.

The purpose of this chapter is to provide for the management and administration of Sunken Park, Cahail Park, Memorial Park, Evergreen Park, Overlook Park, Breezeway Park and David Jones Park. (Ord. 1736 § 1, 2021; Ord. 1545 § 1, 2014; Ord. 1067 § 1, 1998)

12.36.015 Park hours.

All public parks shall be available and open for the use of the public during daylight hours; provided, that the town administrator may establish and post defined hours of operation according to the season during which parks shall be open to the public. The town administrator may also establish extended hours of operation in areas where lighting has been provided, or curtailed hours of operation for other circumstances as deemed appropriate. Extended hours of operation may also be established for specific events in a special event permit or park rental agreement approved by the town administrator. No person shall enter or be present at a park area after the designated closing time. (Ord. 1496 § 2, 2012)

12.36.020 Maintenance and improvement.

The town shall maintain those public park facilities identified in FHMC 12.36.010. Maintenance requirements for public parks shall, at a minimum, include:

A. Removal of litter and debris.

B. Provision of appropriate trash receptacles.

C. Posting of appropriate signage. (Ord. 1496 § 3, 2012; Ord. 1067 § 2, 1998)

12.36.030 Management.

Where any public park or playing field is used by any organized group for any purpose that group shall obtain a permit. Any organized group using any public park or playing field shall be responsible for leaving said park or playing field in a clean and orderly condition and free of litter and debris. 12.36.035 Activities prohibited.

A. It shall be unlawful for any person to use any park or park facilities in a manner or at hours contrary to posted signs.

B. It is unlawful to bring into or consume in any park or park facility any alcoholic beverages except in those areas, or at those events that:

1. Have appropriate licensing from the State of Washington Liquor Control Board; and

2. Have written permission of the town.

C. It is unlawful for any person to smoke or light cigars, cigarettes, tobacco, or other smoking material within a park. The town administrator shall post signs in appropriate locations prohibiting smoking in parks. For the purposes of this section, “smoke” or “smoking” means the carrying, holding, or smoking of any kind of lighted pipe, cigar, cigarette, or any other lighted smoking equipment.

D. It is unlawful to remove, destroy, mutilate or deface any structure, monument, statue, wall, fence, railing, bench, shrub, tree, plant, lighting system, or any other permanent work or facility in any park. (Ord. 1496 § 4, 2012)

12.36.040 Violation and enforcement.

A. A violation of this chapter shall be and hereby is declared both a public nuisance and a Class 3 civil infraction, as defined in Chapter 1.18 FHMC as amended from time to time. Each day that a violation of said chapter exists may be treated as a separate infraction. Subsequent violations by the same individual within a three-year period shall be deemed a Class 2 civil infraction.

B. Except in circumstances where there is a serious and imminent threat to public health or safety, prior to filing a public nuisance abatement action in San Juan County superior court, the town shall attempt to gain compliance by use of the civil infraction procedures set forth in Chapter 1.18 FHMC.

C. The penalty for committing a civil infraction under subsection A of this section shall be as set forth in Chapter 1.18 FHMC. (Ord. 1496 § 5, 2012; Ord. 1067 § 4, 1998)
