9.08.010 Failing to supervise a minor.

A person commits the offense of failing to supervise a minor if the person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under eighteen (18) years of age and the child has been found on private property or premises open to the public in violation of any city ordinance and/or any misdemeanor offense as provided for by Washington state statutes. 9.08.020 Defense.

It shall be a defense to the offense of failure to supervise a minor if the child’s violation of this chapter occurred in the presence of the person. It shall be defense to the offense of failure to supervise a minor if the violation occurred on private property of the person. (Ord. 597 § 2, 1997)

9.08.030 Restitution.

In addition to any fine or penalty imposed pursuant to this chapter, the court may order the person to pay any restitution to a victim of the minor’s conduct. The amount of restitution ordered pursuant to this chapter shall not exceed the estimated damage to the value of the property. (Ord. 718 (part), 2006: Ord. 597 § 3, 1997)

9.08.040 Parental responsibility.

If a child in violation of Section 9.08.010 is eleven (11) years of age or younger, any citation issued shall be issued to the parent, legal guardian or person with legal responsibility for the safety and welfare of the child for violation of this chapter, rather

than to the child for violation of any provision of any city ordinance and/or any misdemeanor offense as provided for by Washington state statutes. (Ord. 597 § 4, 1997)

9.08.050 First offense.

The first time a person is convicted of an offense described in Section 9.08.010, the person shall pay a fine not exceeding one hundred dollars ($100.00). If the person successfully participates and completes a parent effectiveness program to the satisfaction of the court the entire fine may be suspended for up to a period of one year. 9.08.060 Violation—Penalty.

The offense described in this chapter of failure to supervise a minor is an infraction. Each violation will be punished by a fine not to exceed two hundred fifty dollars ($250.00) per violation nor to exceed a fine of two hundred fifty dollars ($250.00) per day that violations occur. All proceedings for the civil violation will be in accordance with Section 1.20.020 of this code. (Ord. 718 (part), 2006: Ord. 597 § 6, 1997)

9.08.070 Disposition of infractions.

The procedure for disposition of infractions issued under this chapter shall be the same as utilized in RCW Chapter 46.63 et seq. and Infraction Rules for Courts of Limited Jurisdiction as adopted and amended by the Washington Supreme Court. (Ord. 597 § 7, 1997)

9.08.080 Bail amount.

Any police officer issuing a notice of infraction under this chapter shall indicate the bail amount on such citation to be one thousand dollars ($1,000.00), unless (1) the police officer has personal knowledge that it is the person’s first offense; or (2) the municipal court of Ilwaco sets a different bail amount by court rule. All proceedings for the infraction will be in accordance with Section 1.20.020 of this code. (Ord. 718 (part), 2006: Ord. 597 § 8, 1997)
