2.92.010 Definitions.

A. “Civil emergency” means:

1. A riot or unlawful assembly characterized by the use of actual force or violence or any threat to use force if accompanied by immediate power to execute such force by three or more persons acting together without authority of law;

2. Any natural disaster or manmade calamity including, but not limited to, flood, conflagration, cyclone, tornado, earthquake, volcanic eruption or explosion occurring in a locality where the impact is manifested within the corporate limits of the city, which results, or would be likely to result, in death, injury or ill health of persons, or the destruction of property to such an extent that extraordinary measures must be taken to protect the public health, safety and welfare.

B. “Curfew” means a prohibition against any person or persons walking, running, loitering, standing or motoring upon any alley, street, highway public property, public or private parking lot, or vacant premises within the corporate limits of the city during the hours in which a curfew has been imposed, excepting persons officially designated to duty with reference to said civil emergency. 2.92.020 Participation in county emergency management council.

A. The city declares its intent to participate in the county emergency management council and pursuant to the terms and provisions of the county’s ordinance establishing such body directs the city manager to serve thereon as the city’s representative.

B. Pursuant to RCW Chapter 38.52 the city prescribes to the methods and procedures for a system of county-wide emergency services as provided by county ordinance. (Ord. 2982 § 3, 1985)

2.92.030 Interlocal agreement.

The city’s participation in the county emergency services program shall be formalized by the execution of an interlocal agreement with the county. At such time as such an agreement is prepared for execution, it shall be brought forward to the city council by the city manager for final approval. (Ord. 2982 § 4, 1985)

2.92.040 Proclamation by mayor—Confirmation by council.

When in the judgment of the mayor a civil emergency as defined in Section 2.92.010 of this chapter is deemed to exist, he shall forthwith proclaim in writing the existence of the same. The proclamation shall be effective immediately; provided, however, such proclamation shall be confirmed by the city council at its next regular or special meeting called for that purpose following the proclamation. 2.92.050 Imposition of curfew.

After proclamation of a civil emergency by the mayor, he may order a general curfew applicable to such geographical areas of the city or to the city as a whole, as he deems advisable and applicable during such hours of the day or night as he deems necessary in the interest of the public safety and welfare. (Prior code § 8.08.030)

2.92.060 Authority to impose additional restrictions.

After proclamation of a civil emergency, the mayor may also in the interest of public health, safety and welfare make any or all of the following orders:

A. Order the closing of all establishments where intoxicating liquor and/or beer is sold or otherwise dispensed or consumed;

B. Order discontinuance of selling, distributing or giving away gasoline or other flammable liquid or combustible products in any container other than a gasoline tank properly affixed to a motor vehicle:

C. Order the closing of gasoline stations and other establishments, the chief activity of which is the sale, distribution or dispensing of flammable liquid or combustible products;

D. Order the discontinuance of selling, distributing, dispensing or giving away of any firearms or ammunition of any character whatsoever;

E. Impose speed and other restrictions on the movement of pedestrian or motor vehicle traffic within the city, including the prohibition of such movement;

F. Issue such other orders as are imminently necessary for the protection of life and property. (Prior code § 8.08.040)

2.92.070 Violation—Penalty.

Violation of any of the provisions of this chapter or any orders or regulations promulgated under this chapter shall be a misdemeanor and punished as provided for other misdemeanors in the city; provided, that the minimum fine imposed for any violation hereof shall be not less than one hundred dollars, which minimum fine shall not be suspended.
