2.60.010 Created.

There is created a Montesano police department. (Ord. 907 §1, 1970).

2.60.020 Duties generally.

It shall be the duty of the police department to enforce all ordinances duly enacted and passed by the city council and all laws of the state of Washington, the United States of America, and the county of Grays Harbor, Washington, over which they have jurisdiction, and to do all things necessary for the prosecution of alleged offenders thereof in a court of competent jurisdiction. (Ord. 1010 §2, 1976).

2.60.030 Police chief--Appointment--Supervisory powers.

(a)    The police department shall have a police chief, who shall be in general charge of the police department. The police chief shall be appointed by the mayor, the appointment to be subject to approval by a majority of the city council at a regular session of the council.

(b)    Until such time as the police chief completes the probationary period established pursuant to Section 2.64.090, then in the event that the mayor determines that it is necessary to remove or terminate the individual designated as police chief, then the mayor shall give notice to the individual and to the council of such desire, stating the reasons therefor. The removal or termination shall not become effective until the decision of the mayor is confirmed by a majority vote of the city council, taken in the same manner as provided for appointment. The term of the civil servant/employee shall be from the date of appointment and confirmation until the date of resignation, retirement or voluntary separation from service or the concurrent action of the mayor and council above referenced, whichever first occurs.

(c)    At such time as the police chief is no longer a probationary employee and is entitled to the procedures established pursuant to Chapter 2.64 as a nonprobationary employee, then the chief of police shall serve at the pleasure of the mayor, subject to the review provisions created by Chapter 2.64. 2.60.040 Police chief--Rule promulgation authority-- Employment of additional personnel.

The chief of police shall, subject to the approval of the mayor, promulgate such rules and regulations pertaining to the administration of the police department as he may deem necessary and proper. The police chief shall employ, subject to compliance with the rules of the Civil Service Commission and the approval of the mayor, such additional personnel, including auxiliary patrolmen, are as necessary to perform the duties referred to in Section 2.60.020. The number of such personnel shall be no greater than that which is established by the city council. (Ord. 1010 §3(b), 1976).

2.60.050 Police chief--Bond.

The police chief shall, upon appointment, take an oath of office and shall execute and deliver to the city council an official bond in such amount as is established in Chapter 2.12 of the Montesano Municipal Code. (Ord. 1010 §3(c), 1976).

2.60.060 Compensation.

The police chief and such additional personnel as he employs shall receive such compensation as the council shall provide from year to year in its annual budget ordinance. (Ord. 1010 §6, 1976).
