2.28.010 Office created – Title for designation.

The title of the office created in the ordinance codified in this chapter shall be known as “office of the finance director of the city of Mount Vernon,” and the title of the appointive officer shall be designated as “finance director of the city of Mount Vernon.” (Ord. 2126 § 1, 1984; Ord. 1668 § 1, 1973).

2.28.020 Office combined – Appointment of clerk-treasurer – Approval required – Bond.

The office of the city treasurer shall be combined with the office of the city clerk, and the duties of such office shall be carried out by the finance director who shall be appointed by and serve at the pleasure of the mayor and which appointment shall be subject to confirmation by the majority vote of the city council. Such appointment must be in writing, signed by the mayor, and filed in the office of the finance director, and subject to filing bond in such an amount as may be required by law. 2.28.030 Powers and duties – Statutory authority – Signing of documents.

The finance director shall exercise all of the powers and duties set out in RCW 35.24.120 for the office of city clerk, and shall in addition exercise all of the powers and duties vested in and performed and required to be performed by the treasurer as set out in RCW 35.24.130. In all cases where the law requires the treasurer to sign or execute any papers or documents, it shall not be necessary for the finance director to sign as treasurer, but shall be sufficient if signed as finance director. For all purposes set forth in state statutes or city ordinances, whenever reference is made to the city clerk or the city treasurer, or the city clerk-treasurer or the office of the city clerk-treasurer such reference shall be construed as referring to the city finance director. 2.28.035 Appointment of deputy city finance director.

A deputy city finance director may be appointed by the mayor. In the absence of the finance director, the deputy shall have all of the powers, duties and authority of the finance director. (Ord. 3141 § 1, 2003).

2.28.040 Offices combined – Effective date.

The combining of the two offices of the city clerk and city treasurer shall become effective on the first day of May, 1973, and on and after the date the office of the city treasurer shall thereupon be abolished, and there shall thereupon be created the office of clerk-treasurer, as provided in RCW 35.24.148, and which office shall be known from and after August 6, 1984, as the office of the finance director. 2.28.050 Compensation.

The compensation of the office of finance director shall be set by ordinance. (Ord. 2126 § 5, 1984; Ord. 1668 § 5, 1973).

2.28.060 Powers and duties – Management of sewer and garbage payment office.

From and after the first day of April, 1964, the management of the sewer and garbage payment office shall be included under the duties of the city finance director, and the billing and collection for sewage and garbage service shall become the responsibility of the city finance director. 2.28.070 Powers and duties – Additional imposed.

The duties imposed by MVMC 2.28.060 upon the city finance director shall be in addition to any other duties imposed upon said office by ordinance or resolution of the city, or by the statutes of the state. (Ord. 2126 § 7, 1984; Ord. 1435 § 2, 1963).

2.28.080 Powers and duties – Investment.

The city finance director shall be and is authorized to invest any portion of the moneys in the city’s inactive funds or in other funds in excess of current needs with reference to the criteria set forth in RCW 35A.40.050 and the additional statutes referenced therein as the same may be now or as they may hereafter be amended. The city finance director shall make a monthly report of all investment transactions, which report shall be provided to all members of the city council. (Ord. 2310 § 1, 1988).

2.28.085 Powers and duties – Surety for deputy city finance director.

The finance director and the finance director’s surety shall be held responsible for the faithful performance of the duties of the deputy and for the true accounting of all city funds coming into his or her possession. (Ord. 3141 § 2, 2003).

2.28.090 Powers and duties – Auditing.

The finance director shall be and is designated as the auditing officer for the purpose of auditing all claims presented against the city by persons furnishing materials, rendering services or performing labor, or for any other contractual purpose. Such audit shall be rendered with reference to the requirements set forth in RCW 42.24.080 as it now exists or as it may hereafter be amended. (Ord. 2311 § 1, 1988).
