16.60.010 Standards designated.

All mobile homes shall be installed in compliance with standards promulgated under WAC 296-150B-200 through and including 296-150B-255 of Chapter 296-150B WAC, known herein as the Mobile Home Installation Code, a copy of which has been filed with the clerk’s office prior to adoption of this chapter. A copy of the standards shall be maintained in the clerk’s office for public inspection. All sections of the Mobile Home Installation Code shall be followed in the city of Oak Harbor, except as explicitly amended in OHMC 16.60.020. (Ord. 936 § 1, 1992).

16.60.020 Installation requirements.

(1) WAC 296-150B-200 general installation requirements for mobile homes shall be amended to read:

A HUD labeled mobile home shall also be installed in compliance with the mobile home manufacturer’s installation instructions. The instructions must be approved by HUD. The manufacturer shall send two copies of its approved installation instructions to the purchaser of the mobile home. The copies shall be in the home and available at the time of inspection.

Mobile homes shall meet all of the standards and requirements of the State of Washington, City of Oak Harbor and any other applicable government regulations in effect at the time of installation. The mobile home shall bear an insignia issued by a state or federal regulatory agency indicating that the mobile home complies with all applicable construction standards of the US Department of Housing and Urban Development.

(2) WAC 296-150B-205 shall be amended to read as follows:

The applicant shall include with the application the permit fee, along with installation documents for the mobile home, site plan, floor plan, tie down details and details for any additional construction associated with the mobile home. A dealer or owner may not deliver a mobile home until it has verified that the owner or the installer has obtained an installation permit for the mobile home.

(3) WAC 296-150B-250 Anchoring Systems. The introductory paragraph shall be amended to read:

296-150B-250 Anchoring Systems. Single-section and multiple-section mobile homes shall have an anchoring system. A single section or multiple section mobile home shall have an anchoring system not less than the requirements of WAC 296-150B-250.

16.60.030 Installation permits.

The owner or the installer of a mobile home must obtain an installation permit from the city of Oak Harbor building department before a mobile home is installed that will be used as a residence on an approved building site. A permit fee shall be charged for single wide mobile homes and for double or triple wide mobile homes per the master fee schedule adopted by resolution of the city council. 16.60.040 Inspection and enforcement.

The building inspector shall inspect the installation of all mobile homes and enforce the provisions of this chapter. (Ord. 936 § 1, 1992).

16.60.050 Violation – Penalty.

Any person, firm or corporation violating any provision of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a fine not to exceed $500.00 or by imprisonment in jail not to exceed six months, or both fine and imprisonment. Each separate day, or any portion thereof, during which any violation of this chapter occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as provided in this chapter. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, this chapter. No permit presuming to give authority to violate or cancel the provisions of this chapter shall be valid, except insofar as the work or use which it authorized is lawful. (Ord. 936 § 1, 1992).
