8.52.010 Declaration of policy.

It is the policy of Okanogan County to promote safety and enjoyment of persons using the waters of this county. This chapter is intended to supplement, but not to infringe upon, the boating safety laws and regulations of the state of Washington and the United States. (Ord. 96-10 § 1, 1996).

8.52.020 Definitions.

A. “Vessel” means every description of watercraft, other than a seaplane, on the water, used or capable of being used as a means of transportation on the water. This definition shall include, but not be limited to, the following: motorboats, sailboats, rowboats, rafts, jet skis, personal watercraft, water skis, surfboards, aquaplanes, canoes, kayaks, barges and trawlers (but not including simple flotation devices such as inner tubes, air mattresses and life jackets).

B. “Motorboat” means any vessel propelled in any respect by machinery, including, but not limited to, those temporarily equipped with detachable motors, and personal watercraft which includes jet skis.

C. “Sheriff” means the sheriff of Okanogan County or any duly appointed deputy sheriff of Okanogan County.

D. “Person” means any natural person, partnership, association or corporation.

E. “Shoreline” means any existing waterline.

F. “Slow minimal wake speed” means very slow speed producing a minimum wake not to exceed six inches in height at its apex when reaching any shoreline, pier or shore installation and further not to exceed eight miles per hour in any event.

G. “Operator” means the individual in physical control of a vessel. The operator of a personal watercraft must be at least 16 years of age and possess a valid driver’s license.

H. “Observer” means the individual riding in a vessel who shall be responsible for observing the water skier at all times. The observer and the operator shall not be the same person. The observer shall be an individual who meets the minimum qualifications for an observer established by rules of the State Parks and Recreation Commission.

I. “Personal watercraft” means a vessel of less than 16 feet, which uses a motor powering a water jet pump as its primary source of motive power and which is designed to be operated by a person sitting, standing or kneeling on, or being towed behind the vessel, rather than in the conventional manner of sitting or standing inside the vessel. (Ord. 96-10 § 2, 1996).

8.52.030 Watercraft registration and display.

A. Registration Certificate. Upon payment of proper fee, the Department of Licensing or its agents shall issue a certificate of registration. The registration document must be signed by at least one owner(s) and carried on board the vessel for which it is issued at all times when the vessel is physically located on the waters of the state of Washington.

B. Vessel Number Required. Except as provided in Chapter 88.02 RCW, no person may use a vessel on the waters of this state unless:

1. It has a number issued on a certificate of registration by the issuing authority in the state in which the vessel is principally used; and

2. The number is displayed as described in WAC 308-93-145.

C. Decals – Placement, Size and Color. Upon registration, the applicant will be issued a registration certificate and two decals. One decal must be affixed to each side on the forward half of the vessel, except when the registration number is placed as provided by WAC 308-93-145(2) and (3). The registration decals must be placed in line with and within six inches of the aft of the registration number. The decals must meet the requirements of subsections (C)(1) and (2) of this section. Only the current registration year decals may be displayed.

1. Decals must be approximately three inches square.

2. The years in which validation decals expire must be indicated by the colors blue, international orange, green and red, in rotation beginning with blue for decals that expire with 1985 expirations.

D. Numbers – Display, Size, Color. Each registration number issued must:

1. Be painted on or permanently attached to each side of the forward half of the vessel except as allowed by subsection (D)(5)(a) of this section or required by subsection (D)(5)(b) of this section;

2. Be in plain vertical block characters of not less than three inches in height;

3. Contrast with the color of the background and be distinctly visible and legible;

4. Have spaces or hyphens that are equal to the width of a letter other than “I” or a number other than “1” between the letter and number groupings (example: DC 5678 EF or DC-5678-EF); and

5. Read from left to right.

a. When a vessel is used by a manufacturer or by a dealer for testing or demonstrating, the number may be painted on or attached to removable plates that are temporarily, but firmly, attached to each side of the forward half of the vessel,

b. On vessels so configured that a number on the hull or superstructure would not be easily visible, the number must be painted on or attached to a backing plate that is attached to the forward half of the vessel so that the number is visible from each side of the vessel, and

c. Each number displayed on a tender exempted under RCW 88.02.030 must meet the requirements of subsection D of this section and have a space or hyphen that is equal to the width of a letter other than “I” or a number other than “1” between the suffix and the number.

E. A violation of subsection A, B, C, or D of this section is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 98-2 § 1, 1998; Ord. 96-10 § 3, 1996).

8.52.040 Equipment – Powering – Lighting.

A. It shall be unlawful in the county to operate or offer for rent any vessel which is in violation of the following United States Coast Guard Regulations and Rules, copies of which are on file with the county auditor and with each city clerk in the county:

1. Equipment requirements, 33 Code of Federal Regulations (hereinafter CFR) 175;

2. Safe loading, 33 CFR 183.31-43;

3. Safe powering, 33 CFR 183.51.67;

4. Navigation lights and shapes, whistles, fog horns, fog bells, and gongs, 46 CFR 25.05;

5. Life preservers and other life saving equipment, 46 CFR 25.25;

6. Fire extinguishing equipment, 46 CFR 25.30;

7. Back fire flame control, 46 CFR 25.35;

8. Ventilation, 46 CFR 25.40;

9. “U.S. Coast Guard Navigation Rules, International-Inland”, as set forth in CG 169, dated May 1, 1977.

B. A violation of subsection A of this section is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 98-2 § 2, 1998; Ord. 96-10 § 4, 1996).

8.52.050 Negligent operation.

A. A person is guilty of negligent operation if he/she operates a vessel upon the waters of Okanogan County in such a manner as to endanger persons or property.

B. A violation of subsection A of this section is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 98-2 § 3, 1998; Ord. 96-10 § 5, 1996).

8.52.060 Intoxicating liquor or drugs.

A. A person is guilty of operating a vessel while under the influence of intoxicating liquor or drugs if he/she operates a vessel on the waters of Okanogan County while:

1. The person has 0.10 grams or more of alcohol per 210 liters of breath, as shown by analysis of the person’s breath made under RCW 46.61.506; or

2. The person has 0.10 percent or more by weight of alcohol in the person’s blood, as shown by analysis of the person’s blood made under RCW 46.61.506; or

3. The person is under the influence of or affected by intoxicating liquor and any drug; or

4. The person is under the combined influence of or affected by intoxicating liquor and any drug.

B. The fact that any person charged with a violation of this section is or has been entitled to use such drug under the laws of this state shall not constitute a defense against any charge of violating this section. A person cited under this subsection may upon request be given a breath test for breath alcohol or may request to have a blood sample taken for blood alcohol analysis. An arresting officer shall administer field sobriety tests when circumstances permit.

C. If at the time alleged the person’s alcohol concentration is less than 0.10, it is evidence that may be considered with other competent evidence in determining whether the person was under the influence of intoxicating liquor or any other drug.

D. A violation of this section is a misdemeanor, punishable as provided under RCW 9.92.030. In addition, the court may order the defendant to pay restitution for any damages or injuries resulting from the offense. (Ord. 96-10 § 6, 1996).

8.52.070 Incapable person operating a vessel.

It shall be unlawful for any person owning or in charge of a vessel to authorize or knowingly permit the vessel to be operated by a person who is under the influence of intoxicating liquor or any drug or who is, by reason of age, experience or physical or mental disability, incapable of safely operating such vessel. (Ord. 96-10 § 7, 1996).

8.52.080 Age restrictions.

A person must be at least 16 years of age and possess a valid driver’s license to operate a motorboat. It shall be unlawful for any person to authorize or knowingly permit anyone under the age of 16 to operate a motorboat, except:

A. When such child is accompanied by a licensed individual, who is at least 18 years of age, capable of safely operating such a motorboat; or

B. When the child is 10 years of age or older and the motorboat has an engine of 15 horsepower or less. (Ord. 96-10 § 8, 1996).

8.52.090 Mooring and anchorage.

A. It shall be unlawful to moor, dock or berth a vessel to fixed or floating structure:

1. Which is privately owned, without the owner’s permission; or

2. Which delineates or is a portion of a designated swimming area.

B. It shall be unlawful to anchor any vessel within any established channel or heavily traveled area, except:

1. When such vessel poses no obstacle to the free movement and safety of other vessels or persons; and

2. When such vessel displays white light in compliance with the United States Coast Guard Regulations. (Ord. 96-10 § 9, 1996).

8.52.100 Noise limitation of motorboats.

No person shall operate a motorized watercraft on any body of water in Okanogan County in such a way that the noise emitted from the watercraft:

A. Exceeds 76 dba between the hours of 7:00 a.m. to 10:00 p.m.; and

B. Sixty-six dba for the hours of 10:00 p.m. to 7:00 a.m. when measured using shoreline passby technique for motorized watercraft.

C. All such motor-driven boats or vessels shall use an adequate and operating muffling device with a series of baffles and chambers, which shall effectively blend the exhaust and motor noise in such a manner as to preclude excessive or unusual noise.

D. It shall be unlawful to remove, disable, bypass or use a cutout device on any muffler or muffling device of any vessel, except while engaged in organized racing events in an area designated for that purpose. (Ord. 96-10 § 10, 1996).

8.52.110 Operation in restricted water area.

A. No person shall operate a vessel within 25 yards of a water area which has been clearly marked with buoys, skin-diving markers, or some other distinguishing markers such as bathing, swimming, skin-diving or other restricted area.

B. Seaplanes, floatplanes and similar conveyances are prohibited from Patterson Lake.

C. The placement or use of any boat outfitted with or containing a combustion engine is hereby prohibited on Davis Lake regardless of whether the operator of the boat intends to or does use the combustion engine or whether the combustion engine is operational.

D. A violation of this section is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 2010-1, 2010; Ord. 98-2 § 4, 1998; Ord. 96-10 § 11, 1996).

8.52.120 Personal watercraft – Additional regulations.

A. “Operator” means the individual in physical control of a personal watercraft. The operator of a personal watercraft shall be at least 16 years of age and possess a valid driver’s license to operate a personal watercraft.

B. No person engaged in the operation of a personal watercraft shall conduct himself or herself in a negligent manner that endangers, or is likely to endanger, any person or property.

C. It shall be unlawful for a person to lease, hire or rent a personal watercraft to any person who is under 16 years of age.

D. Any person under 14 years of age who violates subsection A or B of this section shall be deemed guilty of a misdemeanor.

E. Any violation of subsection A or B of this section by a person between the ages of 14 years and 16 years of age is an infraction punishable by a fine of up to $304.00.

F. Any violation of subsection A or B of this section by a person between the ages of 16 years and 18 years of age is an infraction punishable by a fine of up to $304.00.

G. Any violation of subsection A or B of this section by a person 18 years of age or greater is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 98-6 § 1, 1998; Ord. 98-2 § 5, 1998; Ord. 96-10 § 12, 1996).

8.52.130 Water skiing.

A. For purposes of this section, any person who shall operate a vessel which has in tow another person or persons on water skis, aquaplane, or other similar vessel in tow behind a vessel, shall be deemed engaged in water skiing.

B. Water skiing and/or use of personal watercraft shall be permitted during the following times only:

1. Between the hours of 9:00 a.m. and 6:00 p.m. when lakes are legally open for angling; provided, that during the months of July and August, the permissible hours shall be extended to 9:00 p.m. each Wednesday, Friday and Saturday (see subsection (B)(4) of this section);

2. Between the officially established times of sunrise and sunset when lakes are legally closed to angling;

3. Between the officially established times of sunrise and sunset on the Okanogan River, Lake Osoyoos, Palmer Lake, Methow River upstream from Highway 97 bridge to first overhead power lines, or Columbia River;

4. Water skiing and/or personal watercraft may be used on Pearrygin or Alta Lakes between the hours of 9:00 a.m. to 6:00 p.m. daily; provided, that during the months of July and August, water skiing and/or personal watercraft may be used on Pearrygin Lake between the hours of 9:00 a.m. and 8:00 p.m. each Tuesday, Wednesday and Thursday.

C. It shall be unlawful for any person to engage in water skiing unless:

1. No vessel which has in tow a person or persons on water skis, or similar contrivance, shall be operated on any waters of Okanogan County unless such craft shall be occupied by at least an operator and an observer. The observer shall continuously observe the person or persons being towed and shall display a flag immediately after the towed person or persons fall into the water, and during the time preparatory to skiing while the person or persons are still in the water. Such flag shall be a bright red or brilliant orange color, measuring at least 12 inches square, mounted on a pole not less than 24 inches long and displayed so it is visible from every direction. This subsection does not apply to a personal watercraft, the design of which makes no provision for carrying an operator or any other person on board, and that is actually operated by the person or persons being towed. Every remote-operated personal watercraft shall have a flag attached which meets the requirements of this subsection; and

2. Such water skiing and/or use of personal watercraft is done in a careful and prudent manner and at a reasonable distance from persons and property, unless conditions of water, congestion, weather or other circumstances demand a greater distance, a reasonable distance shall not be less than 25 yards from any person, vessel, swimming dock, or float, boat moorage, buoyed area, skin-diving water areas, or similarly restricted area; and

3. Such water skiing shall be performed in such a way as not to cause the water skis, aquaplane, or similar vessel or any person thereon, to collide with or strike against any person or object, other than a jumping ramp or in conjunction with skiing over a slalom course; and

4. No person shall engage or attempt to engage in water skiing, or operate or ride on a personal watercraft, without wearing an adequate and effective United States Coast Guard approved Type I, II, or V personal flotation device in good and serviceable condition and of appropriate size, or a wet suit which is approved for personal flotation by the United States Coast Guard. A person operating a personal watercraft equipped by the manufacturer with a lanyard type engine cutoff switch must attach the lanyard to his or her person, clothing, or personal flotation device as is appropriate for specific vessel. It is unlawful for any person to remove or disable a cutoff switch which was installed by the manufacturer.

D. Water skiing at speeds in excess of those permitted in OCC 8.52.150 is allowed for the limited purpose of launching and returning person(s) in tow so long as such operation conforms to the water traffic pattern set forth in OCC 8.52.190 and with the other provisions of this chapter.

E. Any violation of subsection (B)(1), (B)(4), C, or D of this section is an infraction punishable as provided under Chapter 7.84 RCW and OCC 8.52.230. (Ord. 98-6 § 2, 1998; Ord. 98-2 § 6, 1998; Ord. 97-6 § 1, 1997; Ord. 96-10 § 13, 1996).

8.52.140 Races and regattas.

A. It shall be unlawful to hold regattas, motorboat, or other boat races, or other similar events in Okanogan County, unless prior authorization is first obtained from the county sheriff. Person(s) or organization(s) desiring to sponsor such events shall apply to the sheriff at least 10 days in advance of the commencement of such events for a permit. Such applications shall be submitted on forms provided by the sheriff and shall specify the waters and general area where the event shall be held, the buoys or other marking devices the sponsor of such event shall place upon the waters to set off any race course or other area, the provisions made by the sponsors for patrolling to protect the course or other area, the provisions made by the sponsors for patrolling to prevent the unauthorized entry into the area of nonparticipants, and to protect others from injury or damages, the dates of such events, including the dates of trial practice and preliminary events, and such other information as the sheriff may require to fully inform him of the nature and extend of such an event.

B. Each permit application shall be accompanied by a fee of $25.00, and a bond of not less than $5,000, payable to the county, to hold the county harmless from any injury or damage which may result from such event, and to insure that requirements for markers, rescue equipment, or other safety conditions stated in the approved final application are actually provided.

C. Within 10 days after receiving such applications, if adequate provisions are made for the safety of the participants and the general public, the sheriff may issue a permit for such events. Such permit shall be issued subject to the condition that the applicant will fulfill the provisions specified in the application. Such permit may be revoked by the sheriff in the name of Okanogan County for the public safety.

D. The provisions of this section shall not exempt any person from compliance with applicable federal law or regulation, but nothing contained herein shall be construed to require the securing of a county permit pursuant to this section if a permit therefor has been obtained from an authorized agency of the United States. (Ord. 96-10 § 14, 1996).

8.52.150 Speeding restrictions.

A. Except as otherwise provided, no vessel shall be operated at a speed in excess of the slow minimal wake speed.

B. Vessels may be operated at a speed in excess of the slow minimal wake speed, if:

1. The vessel is not operated within 50 yards of any pier or dock (see OCC 8.52.130(D)); and

2. The speed is reasonable and prudent under the conditions and having regard for actual and potential hazards; and

3. The vessel is not operated at a speed to exceed 35 miles per hour at Pearrygin Lake or the Methow River upstream from the Highway 97 bridge to first overhead power lines, or eight miles per hour on Sidley, Leader, Beth, Lost, Bonaparte, Duck, Wannacut, Patterson, Big and Little Beaver Lakes, and Lake Osoyoos from the state park boat launching ramp south to Cherry Street bridge down the Okanogan River. (Ord. 2006-6 § 1, 2006; Ord. 96-10 § 15, 1996).

8.52.160 Depositing refuse, litter, sewage, etc.

A. It is unlawful to throw or to place debris, litter, untreated sewage, or to construct or cause to be constructed, or to place any object, either permanent or temporary on or in any body of water under the jurisdiction of Okanogan County. This includes, but is not limited to, pen bottles, jars, cans, ramps, floats, logs or any other object that is or may became a hazard to the normal use of any person either boating, fishing or swimming.

B. This section in no way prohibits or limits the construction of placement of docks, markers, or anchored buoys to serve person(s) living along the shores or banks of water, providing that those docks, markers or anchored buoys be firmly anchored or attached in such a manner as to not become a hazard to any person or persons, either while boating, fishing or swimming. (Ord. 96-10 § 16, 1996).

8.52.170 Accident reports.

A. Every accident involving a vessel in waters of the county which results in any personal injury or in any property damage in excess of $500.00 shall be reported to the Okanogan County sheriff by the operator of the vessel. The sheriff shall provide forms upon which such reports must be prepared. Any person who violates this section shall be deemed guilty of an infraction, punishable as provided under Chapter 7.84 RCW and OCC 8.52.230.

B. The operator of a vessel is guilty of a class C felony and is punishable pursuant to RCW 9A.20.021 if the operator: (a) is involved in a collision that results in injury to a person; (b) knew or reasonably should have known that a person was injured in the collision; and (c) leaves the scene of the collision without rendering all practical and necessary assistance to the injured person as required pursuant to RCW 88.12.155(1), under circumstances in which the operator could have rendered assistance without serious danger to the operator’s own vessel or persons aboard. This subsection does not apply to vessels involved in commerce, including but not limited to tugs, barges, cargo vessels, commercial passenger vessels, fishing vessels, and processing vessels. 8.52.180 Scuba diving and swimming.

Persons engaging in scuba diving shall mark the area where such operations are being conducted with buoys or markers which can be seen from a distance, at that time, of not less than 100 yards. (Ord. 96-10 § 18, 1996).

8.52.190 Water skiing – Water traffic patterns.

A. All persons engaged in water skiing shall leave the shoreline at an angle of 45 degrees with the shoreline on the skier’s right.

B. Water skiers on lakes are encouraged to ski in a counterclockwise direction. (Ord. 96-10 § 19, 1996).

8.52.200 Enforcement.

A. It shall be the duty of the sheriff to enforce the provisions of this chapter.

B. When a violation of this chapter is made in the presence of the sheriff or a deputy sheriff, he may board any vessel and may arrest the violator(s). In all other cases, arrest for violation of this chapter shall be made pursuant to a warrant.

C. The sheriff, or an officer of the sheriff’s department, shall have authority to stop and board a vessel for the purpose of inspection and determining compliance with this chapter.

D. Any operator of a vessel who willfully fails to stop when requested or signaled to do so by a person reasonably identifiable as a law enforcement officer is guilty of a gross misdemeanor (Chapter 88.08 RCW, Section 1).

E. Any operator of a vessel who willfully fails or refuses to immediately bring the vessel to a stop and who operates the vessel in a manner indicating wanton or willful disregard for the lives or property of others while attempting to elude a pursuing law enforcement vessel to a stop shall be guilty of a Class C felony punishable under Chapter 9A.20 RCW. The signal given by the law enforcement officer may be by hand, voice, emergency light, or siren. The officer giving such a signal shall be in uniform and his or her vessel shall be appropriately marked showing it to be an official law enforcement vessel (Chapter 88.08 RCW, Section 2). (Ord. 96-10 § 20, 1996).

8.52.210 Citation for violation – Promise to appear.

Whenever any person is arrested for any violation of this chapter, the arresting officer may serve upon him a citation and notice to appear in court. The arrested person, in order to secure a release, and when permitted by the arresting officer, must give his written promise to appear in court, as required by citation and notice, by signing in the appropriate place the written citation and notice served by the arresting officer. Upon the arrested person’s failing or refusing to sign such written promise, he may be taken into the custody of such arresting office and so remain or be placed in confinement. (Ord. 96-10 § 21, 1996).

8.52.220 Penalty for violations.

Except where otherwise provided, any person who violates this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not over $250.00, or by imprisonment of not over 90 days in the county jail. (Ord. 96-10 § 22, 1996).

8.52.230 Bail schedule.
