SIDEWALK REPLACEMENT

11.16.010 Construction.

All sidewalks or portions thereof that abut the streets set forth in Section 11.16.020 that are replaced after the effective date of the ordinance codified in this chapter shall be constructed using the materials and according to the material and construction specifications set forth in Section 11.16.030, except that sidewalk replacement areas less than fifty square feet shall not be subject to the provisions of this chapter. No person shall purposely divide sidewalk replacement areas into segments smaller than fifty square feet to avoid the provisions of this chapter. (Ord. 1109 § 1, 1989: Ord. 1015 § 1, 1987).

11.16.020 Applicability.

This chapter shall be applicable to all sidewalks abutting the following streets:

(a)    Main Street from Cherry Avenue south to Second Avenue;

(b)    Ash Street from Bartlett Avenue south to Second Avenue;

(c)    Bartlett Avenue from Juniper Street west to Ash Street;

(d)    Apple Avenue from Juniper Street west to Ash Street;

(e)    Central Avenue from the Central Avenue bridge west to Ash Street;

(f)    First Avenue from the Okanogan River dike west to Ash Street;

(g)    Second Avenue from the Okanogan River dike west to Ash Street. (Ord. 1015 § 2, 1987).

11.16.030 Construction specifications.

All sidewalks replaced within the areas specified in Section 11.16.020 shall be constructed according to the requirements of Chapter 11.08 of the Omak Municipal Code and the following material and construction specifications:

ASTM C936-82, Standard Specifications for solid concrete interlocking paving tiles of style, design and color matching previous installation. (Ord. 1015 § 3, 1987).

11.16.040 Conflicting provisions.

Any portion of Chapter 11.08 of the Omak Municipal Code in conflict with this chapter shall not apply to the construction/replacement of sidewalks within the areas described in Section 11.16.020. (Ord. 1015 § 4, 1987).

11.16.050 Violation—Penalty.

Any person, firm or corporation violating any provisions of this chapter shall be found to have committed a civil infraction. Any such person found to have committed such a civil infraction shall be assessed a monetary penalty, which penalty shall not exceed three hundred dollars for each offense. Each day during which a violation is committed or continued shall be deemed a separate offense and separate penalties may be assessed for each separate offense. (Ord. 1148 § 3, 1990).
