10.14.010 Definitions.

For purposes of this chapter:

“Engine compression brake” means a motor vehicle brake which is activated or worked by the compression of the engine of a motor vehicle. (Ord. 522 § 1 (part), 2005)

10.14.020 Prohibition—Exception.

Engine compression brakes shall not be used at any time on city streets of Rainier by trucks or truck tractors or other motor vehicles except public safety emergency vehicles, unless the noise created by their use is effectively muffled to a reasonable level as near as possible to the level of the ordinary muffler of the vehicle. 10.14.030 Violation—Penalty.

A violation of Section 10.14.020 is a misdemeanor and shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000) per violation. (Ord. 522 § 1 (part), 2005)

10.14.040 Applicability.

It is expressly the purpose of this chapter to provide for and promote the health, safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefitted by the terms of this chapter. (Ord. 522 § 1 (part), 2005)

10.14.050 Non-liability of city.

It is the specific intent of this chapter that no provisions or any term used in this chapter are or is intended to impose any duty whatsoever upon the city or any of its officers or employees, for whom the implementation and enforcement of this chapter shall be discretionary according to available resources of the city.

Nothing contained in this chapter is intended or shall be construed to create or form the basis of any liability on the part of the city, or its officers, employees or agents, for any injury or damage resulting from any action or inaction on the part of the city related in any manner to the enforcement of this chapter by its officers, employees or agents.
