1.31.010 Created.

Pursuant to the provisions of Chapter 38.52 RCW, the city council of the city of Ritzville does hereby create a department of emergency services in accordance with the State Emergency Services plan and program. (Ord. 698 § 1, 1982).

1.31.020 Chapter 38.52 RCW adopted by reference.

Where applicable, the provisions of Chapter 38.52 RCW as it now exists and as it will hereafter be amended, are adopted by this reference. (Ord. 698 § 2, 1982).

1.31.030 Coordination with other agencies.

The department of emergency services of the city of Ritzville may, in coordination with other public and private agencies and political subdivisions within the state, develop or cause to develop mutual aid arrangements for reciprocal emergency services aid and assistance in case of disaster too great to be dealt with unassisted. (Ord. 698 § 3, 1982).

1.31.040 Submission of plan and programs.

The Ritzville department of emergency services shall submit its plan and programs for emergency services to the State Director of Emergency Services and secure his recommendations thereon. (Ord. 698 § 5, 1982).

1.31.050 Appointment of director.

The Ritzville department of emergency services shall have a director who shall be appointed by the mayor, and who shall have direct responsibility for the organization, administration and operation of the department of emergency services, subject to the direction and control of the mayor; provided, however, that if there is established a joint operation for emergency services, the director shall be appointed by the joint action of the mayor and the executive head of any cooperating political subdivision. 1.31.060 Powers and duties.

A. In carrying out the provisions of Chapter 38.52 RCW, the Ritzville department of emergency services shall have the power to enter into contracts and incur obligations necessary to combat such disaster, protecting the health and safety of persons and property and providing emergency assistance to the victims of such disaster.

B. Such powers set out under this section may be exercised without regard to time-consuming procedures and formalities prescribed by law, (except mandatory constitutional requirements), including but not limited to:

1. Budget law limitations;

2. Requirements of competitive bidding and publication of notices pertaining to the performance of public work;

3. Entering into contracts;

4. The incurring of obligations;

5. The employment of temporary workers;

6. The rental of equipment;

7. The purchase of supplies and materials;

8. The levying of taxes and the appropriation of expenditures of public funds; and

9. Any and all other powers as may be set forth in Chapter 38.52 RCW, and any amendments hereinafter enacted. (Ord. 698 § 4, 1982).

1.31.070 Violation of rules – Punishment.

Every violation of any rule, regulation and/or order issued under the authority of Chapter 38.52 RCW, whether by the Governor of the state, or by the Ritzville department of emergency services, shall constitute a misdemeanor and shall be punishable as such; provided, that whenever any person shall commit a second offense hereunder the same shall constitute a gross misdemeanor and shall be punishable as such.
