12.12.010 Definitions.

The terms used in this chapter, unless clearly contrary to or inconsistent with the context in which used shall be construed as follows:

A. “Commissioner” means the commissioner of the park and recreation department of the city.

B. “Department” means the park and recreation department of the city.

C. “Park” means and includes all city parks, public squares, ponds, park drives, parkways, boulevards, ballparks, and play and recreation grounds and facilities under the jurisdiction of the department.

12.12.020 Destroying facilities.

It is unlawful to remove, destroy, mutilate or deface any properties, plantings, equipment or facilities or to enter or break in any locked restroom facilities or other park buildings or structures.

12.12.030 Animal running at large.

It is unlawful for any person to allow or permit any animal to run at large in any park or enter any lake, pond, fountain or stream therein.

12.12.040 Firearms and explosives.

It is unlawful to shoot, fire or explode any firearm, fireworks, firecracker, torpedo or explosive of any kind or to carry any firearm or to shoot or fire any air gun, bows and arrows, B.B. gun or use any slingshot in any park except designated recreational areas provided for such activities.

12.12.050 Proper treatment of animals.

It is unlawful in any manner to tease, annoy, disturb, molest, catch, injure or kill or to throw any stone or missile of any kind or strike with any stick or weapon any animal, bird, or fowl in any park.

12.12.060 Unlawful acts.

It is unlawful, without first obtaining the written consent of the commission in each case, to do or permit to be done any of the following acts or things in any park:

A. To use, place or erect any signboard, sign, billboard, bulletin board, post, pole or device of any kind for advertising in any park, or to attach any notice, bill, poster, sign, wire, rod or cord to any tree, shrub, railing, post or structure within any park, or to place or erect in any park a structure of any kind;

B. To take up collections or to act as or to ply the vocation of solicitor, agent, strolling musician, organ grinder, exhorter, barker, showman or bootblack, or to use any loudspeaker;

C. To sell refreshments or merchandise or distribute literature; or

D. To hold or participate in any political meeting or other assembly.

12.12.070 Vehicle regulations.

It is unlawful to ride or drive any bicycle, motorcycle, motor vehicle, horse or pony over or through any park except along and upon the park drives, parkways, park boulevards and bicycle paths; or at a speed in excess of 10 miles per hour; or to stand or park any such vehicle, except in areas so designated.

12.12.080 Camping regulations.

It is unlawful to camp in any park except at places set aside for such purpose by the department and so designated by signs, and it is unlawful to remain, stay or loiter in any park between the hours of 10:00 p.m. and 6:00 a.m., except in designated camping areas.

12.12.090 Depositing refuse.

It is unlawful to throw any refuse, litter, broken glass, crockery, nails, shrubbery, trimmings, junk or advertising matter in any park or to deposit any such material therein, except in designated receptacles.

12.12.100 Trials or competitions prohibited.

It is unlawful to engage in, conduct or hold any trials or competitions for speed, endurance or hill climbing involving any vehicle, boat, aircraft or animal in any park, or public street adjacent thereto.

12.12.110 Fire regulations.

It is unlawful to build any fires in any park except in areas designated by the department.

12.12.120 Intoxicating liquors.

It is unlawful to bring into or consume in any park any whiskey, wine, beer or other intoxicating liquors.

12.12.130 Violation – Penalty.

Any person who shall violate or fail to comply with the provisions of this chapter, or who shall counsel, aid or abet any such violation, shall be deemed guilty of a misdemeanor and shall be punished by a fine in any sum not to exceed $300.00, or by imprisonment in the city jail or other comparable institution for a term not to exceed 30 days, or by both such fine and imprisonment.
