7-3-1 PARKING PROHIBITED IN SPECIFIED PLACES:

Except when necessary to avoid conflict with other traffic, or in compliance with the law or the direction of a police officer or official traffic control device, no person shall:

A.    No Parking Areas: Stop, stand or park any automobile, truck or other vehicle:

1. On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

2. On a sidewalk or street planting strip.

3. Within an intersection.

4. On a crosswalk.

5. Between a safety zone and the adjacent curb or within thirty feet (30') of points on the curb immediately opposite the ends of a safety zone, unless official signs or markings indicate a different no parking area opposite the ends of a safety zone.

6. Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.

7. Upon any bridge or other elevated structure upon a highway or within a highway tunnel.

8. On any railroad tracks.

9. In the area between roadways of a divided highway, including crossovers.

10. From the corner of Fourth and Peterson Streets to the Roy Elementary School gate.

11. At any place where official signs prohibit stopping.

B.    Pick Up Or Discharge Passengers: Stand or park any automobile, truck or other vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:

1. In front of a public or private driveway or within five feet (5') of the end of the curb radius leading thereto.

2. Within fifteen feet (15') of a fire hydrant. (Ord. 562, 9-14-1998)

3. Within twenty feet (20') of a crosswalk. (Ord. 562, 9-14-1998; amd. 2006 Code)

4. Within thirty feet (30') upon the approach to any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway.

5. Within twenty feet (20') of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy five feet (75') of said entrance when properly signposted.

6. At any place where official signs prohibit standing.

C.    Loading Or Unloading Property Or Passengers: Park any automobile, truck or other vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers:

1. Within fifty feet (50') of the nearest rail of a railroad crossing.

2. At any place where official signs prohibit parking. (Ord. 501, 9-9-1996)

D.    Time Limit: Between the hours of eight o’clock (8:00) A.M. and five o’clock (5:00) P.M., stop, stand, or park any automobile, truck, or other vehicle, whether occupied or not, for more than thirty (30) minutes on the east side of McNaught Street, beginning on the north side of Third Street and extending one hundred ten feet (110') north towards Second Street, except Saturdays, Sundays and legal holidays. 7-3-2 EXCEPTIONS; POLICE AND MAINTENANCE:

The provisions of section 7-3-1 of this chapter do not apply to police emergency or city maintenance vehicles. (Ord. 501, 9-9-1996)

7-3-3 MOVING VEHICLE UNLAWFULLY:

No person shall move a vehicle not lawfully under his or her control into any such prohibited area or away from a curb such a distance as is unlawful. (Ord. 501, 9-9-1996)

7-3-4 PARKING TO THE EXCLUSION OF OTHERS:

It shall be unlawful for any person to reserve or attempt to reserve any portion of a street for the purpose of stopping, standing or parking to the exclusion of any other like person, nor shall any person be granted such right. (Ord. 501, 9-9-1996)

7-3-5 PARKING FOR CERTAIN PURPOSES:

The parking and storage of motor vehicles or objects upon city streets and rights of way for any of the following purposes or in the following manner is prohibited:

A.    Inoperative Vehicles: Parking or storage of a motor vehicle which is temporarily or permanently inoperative for any reason whatsoever, including lack of proper license, except parking for emergency repairs not requiring more than forty eight (48) consecutive hours’ total time shall be permitted.

B.    Boats, Mobile Homes, Trailers: Parking or storage, at any time for any reason, of a boat, boat trailer, house trailer, travel trailer, mobile home, camper, flatbed trailer, utility trailer or any other vehicle, object or trailer incapable of self-locomotion.

C.    Motor Homes: Parking or storage of a self-propelled motor home for more than forty eight (48) consecutive hours; provided, that this time may be extended by permission granted by the chief of police.

D.    Wood, Rocks, Building Materials: Storage of firewood, building materials, sand, gravel, sawdust, beauty bark, rocks or any other materials of any kind whatsoever for a period in excess of that reasonably necessary for its removal from the street onto private property for any period in excess of forty eight (48) consecutive hours shall be presumed to be unreasonable. 7-3-6 PARKING AND USE OF MOTOR HOMES, CAMPERS:

It is unlawful for the owner, operator or lessee of any motor home, truck camper, camping trailer, travel trailer, bus or van, or any person in possession thereof, to park, or cause or permit the same while used for living, sleeping or housekeeping quarters, to stand, or be upon any private property within the corporate limits of the city, except in a trailer park; provided, however, that such vehicles may be lawfully parked for use and occupancy upon private property for the purpose of visiting the person in possession of the private property or during a special event (i.e., rodeo and carnival) for a period of not more than ten (10) days in case the person in possession thereof has first obtained from the chief of police a written permit therefor and written consent from the owner or owners of the private property for such parking; provided, that the chief of police may extend the time up to ten (10) additional days. 7-3-7 AUTHORITY TO IDENTIFY RESTRICTIVE ZONES:

The mayor or designee is authorized to identify and designate by appropriate signage parking restrictions, time limitations and parking prohibitions for certain streets of the city, in order to provide for reasonable parking availability and safe use of city streets. (Ord. 935, 12-14-2015)

7-3-8 PENALTIES:

A.    A person who violates any provisions of this chapter, except section 7-3-6, shall be deemed to have committed an infraction and shall be punished by a penalty of not less than twenty five dollars ($25.00), in addition to other costs and assessments provided by law.

B.    A person who violates any of the provisions of section 7-3-6 shall be deemed to have committed an infraction and shall be punished by a penalty of not less than fifty dollars ($50.00), in addition to other costs and assessments provided by law. Vehicles in violation of section 7-3-6 may be subject to impoundment as provided by law. (Ord. 733, 8-22-2005; Ord. 935, 12-14-2015)
