12.06.010 Duty of owner to remove snow from sidewalk.

A. An owner of any property located within the city that is adjacent to a public sidewalk shall be responsible for the removal of snow and ice that may fall or accumulate on the sidewalk. The owner shall make a reasonable effort to clear any sidewalk adjacent to their property of snow and ice within 48 hours after snowfall or ice accumulation.

B. In the event that snow or ice accumulates so that it is not practical to remove it from the sidewalk, the owner of the adjacent property shall provide for the dispersal of sand or other suitable material on the sidewalk in order to allow the sidewalk to be used in a reasonably safe manner.

C. The provisions of subsections A and B of this section shall apply to the city with respect to city-owned buildings and other high-priority snow removal areas. The city shall comply with the requirements of the Americans with Disabilities Act.

D. The provisions of subsections A and B of this section shall not apply to those owners of property who are senior citizens or who are physically unable to comply with the provisions. (Ord. 1244 § 1, 2021).

12.06.020 Enforcement.

Violation of any subsection of SMC 12.06.010 shall be a civil infraction. A first or second violation shall carry no penalty. A third violation and any subsequent violation shall be subject to a monetary penalty of no more than $25.00. (Ord. 1244 § 1, 2021).
