2.42.010 Police department.

A. There is established in the city a police department.

B. The police department shall be under the direction of a chief of police.

C. The department shall be responsible to the mayor for effective law enforcement and shall have all the powers and perform such other duties as provided by the laws of the state, ordinances, and resolutions, and as directed by the mayor.

D. The mayor shall appoint the police chief as provided by law.

E. The chief of police shall be responsible to the mayor for management of the police department and supervision and training of departmental employees. (Ord. 1051 § 3, 2006).

2.42.030 Civil service – Chapter 2.45 SLMC prevails when.

The provisions of Chapter 2.45 SLMC shall prevail as to hiring, promotion, demotion or discharge of personnel in cases of any conflict with this chapter. (Ord. 798 § 3, 1992).

2.42.040 Chief of police – Powers and duties – Generally.

There is created and established the position of chief of police of the city. The chief of police shall be appointed by the mayor after certification by the city civil service commission in conformity with the rules and regulations of the civil service commission. He shall take an oath of office to faithfully defend the Constitution of the United States of America, the constitution of the state of Washington, and the laws thereunder, including all ordinances of the city. He shall have charge and supervision of all personnel and property devoted to the use of the police department. He shall enforce the rules and regulations governing the organization of the department, and may make such rules and regulations reasonably necessary for the conduct of the department. 2.42.050 Chief of police – Attendance at council meeting required.

The chief of police, or his delegate, shall attend each meeting of city council, and perform the duties of sergeant-at-arms unless excused from attendance by the mayor. (Ord. 798 § 7, 1992).

2.42.090 Chief of police – Authorized to promulgate additional orders.

The chief of police shall have the duty and the authority to promulgate additional standing general orders and procedures, in writing, consistent with this chapter, and provide penalties accordingly. (Ord. 798 § 22, 1992).

2.42.100 Subordinate positions.

In addition to the position of chief of police, there are established the position of patrol officer and such other subordinate positions in such number as shall be provided each year in the annual budget ordinances of the city, who are referred to as line officers. (Ord. 1051 § 2, 2006; Ord. 798 § 8, 1992).

2.42.120 Classification of officers.

2.42.130 Mayor to appoint additional officers.

The mayor shall, subject to the provisions of this chapter, appoint such other city police officers classified under civil service as may be authorized by ordinance with approval of the city council. (Ord. 798 § 5, 1992).

2.42.140 Advancement of officers.

Repealed by Ord. 1051. (Ord. 798 § 11, 1992).

2.42.150 Salaries.

The chief of police and all other full-time city police officers shall be paid such salary as may annually be fixed by the city council. (Ord. 798 § 6, 1992).

2.42.160 Physical examinations – Required of officers.

Repealed by Ord. 1051. (Ord. 798 § 26, 1992).

2.42.170 Reserve police officers – Disclosure of information.

Repealed by Ord. 1051. (Ord. 798 § 14, 1992).

2.42.180 Professional obligation of all officers.

All personnel of the police department should thoroughly familiarize themselves with the provisions of the city code, and shall carry out their services to the city with pride in their profession, courtesy and courage in the prosecution of their duties, discretion in the investigation and prosecution of cases, and fidelity to city, state and federal government. (Ord. 798 § 24, 1992).

2.42.190 Criticism of orders.

Repealed by Ord. 1051. (Ord. 798 § 23, 1992).

2.42.200 Contributions, solicitations and subscriptions.

No contributions, solicitations or subscriptions shall be made by any member to buy a gift intended for any other city official or employee. Police personnel shall not in their official capacity collect or receive money or anything of value from any citizen without the knowledge and permission of the chief of police. (Ord. 798 § 16, 1992).

2.42.210 Gifts or gratuities to officers – Prohibited.

Any gifts, gratuity, discount or favor tendered to any officer of the department shall be firmly but tactfully declined by the officer, who shall advise the person involved of the provisions of this chapter. This chapter shall not derogate in any way from the duty of the officer to report any bribery or attempted bribery coming to his attention. (Ord. 798 § 17, 1992).

2.42.220 Divulging criminal records – Prohibited.

Repealed by Ord. 1051. (Ord. 798 § 18, 1992).

2.42.230 False reports.

No member of the police department knowingly shall make a false report or falsify any report or record or be a party to intentionally reporting inaccurate or false information with respect to any investigation, record or prosecution in which the officer shall be involved. (Ord. 798 § 19, 1992).

2.42.240 Firearms.

2.42.250 Gossip, rumors, loose talk.
