OVERTIME COMPENSATION FOR CITY EMPLOYEES

2.72.010 Definitions.
(a) Overtime Hours Worked. All hours of employment of a salaried employee in excess of one hundred seventy-six hours per month (based upon each calendar month as a separate wage period) shall be considered overtime hours for the purpose of computing overtime compensation under this chapter.
(b) Salaried Employee. A salaried employee shall be any employee of the city of Sumas who is paid a flat salary on the basis of per day, per week or per month, as the case may be, and not paid on an hourly basis.
(c) Salaried Employee Determined Hourly Wage.
The determined hourly wage of a salaried employee shall equal employee’s monthly salary divided by one hundred seventy-six hours. (Ord. 831 § 3, 1982)
2.72.020 Intent.
It is the intent of this chapter that the city shall have the authority to grant overtime pay or compensation to salaried employees in such instances where the salaried employee has expended overtime hours for the city; however, nothing in this chapter shall be construed as directing the city or imposing a duty on the city to pay overtime compensation in every instance where overtime has been expended by a salaried employee, it being the intent and purpose of this chapter that whether or not overtime is awarded to a salaried employee shall be subject to the sound discretion of the council on recommendation from the mayor. 2.72.030 Authorized methods of payment.
The mayor, with the approval of the Sumas city council, is authorized to grant overtime compensation to its salaried employees for overtime work authorized and expended by the salaried employee on behalf of the city by either one of the following two methods:
(1) Paying such salaried employee one and one-halftimes the salaried employee’s determined hourly wage, as defined in this chapter, for each overtime hour, as defined in this chapter, expended by the salaried employee on behalf of the city during a monthly salary period; or
(2) Granting such salaried employee compensatory time off (as defined in this chapter) with pay for each overtime hour worked. (Ord. 831 § 1, 1982)
