DRUG-FREE WORKPLACE POLICY

(a) No employee shall unlawfully manufacture, distribute, dispense, possess, use, or be under the influence of any narcotic drug, hallucinogenic drug, amphetamine, barbiturate, marijuana, alcohol or any other controlled substance either on or in the workplace.
(b) “Workplace” includes any city building or any city premises and any city-owned vehicle. (Ord. 1134 § 1, 1994)
2.94.020 Notification of drug-related conviction–Action by city.
(a) As a condition of employment, each employee shall notify his or her supervisor of his or her conviction under any criminal drug statute for a violation occurring in the workplace as defined in Section 2.94.010. Such notification shall be provided no later than five days after such conviction.
(b) In addition, the city shall notify any granting agency within ten days after the employee notifies the city. The city shall take action within thirty days after receiving notice, either appropriate personnel action or the requirement that an employee participate in a drug abuse assistance or rehabilitation program. 2.94.030 Compliance with policy required for employment.
As a condition of employment, each employee shall abide by the terms of the city policy respecting a drug-free workplace. (Ord. 1134 § 3, 1994)
2.94.040 Violation.
An employee who violates the terms of this policy may be suspended, discharged or nonrenewed in accordance with the provisions of city policy, state law and/or any collective bargaining agreements. (Ord. 1134 § 4, 1994)
2.94.050 Reinstatement.
As a condition of eligibility for reinstatement, an employee may be required to satisfactorily complete a drug rehabilitation or treatment program approved by the council, at the employee’s expense. Nothing in this policy shall be construed to guarantee reinstatement of any employee who violates this policy, nor does the city incur any financial obligation for treatment or rehabilitation ordered as a condition of eligibility for reinstatement. 2.94.060 Drug-free awareness program.
The city shall establish an ongoing drug-free awareness program. (Ord. 1134 § 7, 1994)
