2.68.010 Equipment Rental Fund – Established – Purposes – Exemptions.

A. Pursuant to RCW 35.21.088, there is created a special fund to be known as the Equipment Rental Fund, which shall be a revolving fund. All equipment transferred to or funds deposited in such fund shall be expended for the following purposes:

1. Paying salaries and wages and otherwise financing operations required for the repair, replacement, purchase and operation of all mobile vehicular equipment owned by the City; and

2. Purchasing equipment, materials and supplies incidental to the operation and maintenance of such vehicular equipment; and

3. Purchasing equipment, materials and supplies to be used in the administration and operation of the fund.

B. The equipment used solely by the Fire and Police Departments and such specialized equipment in the Water and Sewer Department or any other department as may be deemed by the Finance Director unfeasible to transfer shall not be included in the assets of the fund. [Ord. 1223 § 1, 1979.]

2.68.020 Transferal from former jurisdictions.

All mobile vehicular equipment owned by the City, except such equipment used by the Fire, Police and aforementioned special equipment in the Water and Sewer Department or any other department, and all property assets and liabilities of the City Shop presently included under the City’s general fixed asset accounts are transferred, effective January 1, 1979, without charge, to the Equipment Rental Fund. No credit shall be given any office or department for the value of any equipment or facilities transferred pursuant to the ordinance codified in this chapter. [Ord. 1223 § 2, 1979.]

2.68.030 Rental terms.

Equipment owned by the Equipment Rental Fund may be rented for the use of the various offices and departments of the City and other governmental agencies at such rates and upon such terms and conditions as the Council shall adopt by resolution from time to time. The charges for rental of such equipment shall be sufficient to cover the repair, replacement, purchase and operation thereof, and the terms of rental shall be on annual, monthly, weekly, daily, hourly, mileage, or other basis as determined by the Director of Public Works. A schedule of such charges shall be prepared by the Director of Public Works, subject to the approval of the City Council. Such rental rates shall be reviewed, and if need be, revised periodically to meet changing costs of repair, replacement, purchase and operation. [Ord. 1350 § 1, 1982; Ord. 1223 § 3, 1979.]

2.68.040 Equipment Rental Department – Created – Administration.

There is created an Equipment Rental Department to administer the Equipment Rental Fund. The Equipment Rental Department shall be under the control and supervision of the Director of Public Works. The personnel of said department shall consist of such employees as the City Manager and/or City Council may deem necessary. The Director of Public Works is authorized to establish rules and regulations to administer the equipment rental fund under the provisions of this chapter. [Ord. 1223 § 4, 1979.]

2.68.050 Maintenance of other equipment.

Vehicles and equipment owned by other departments of the City may be serviced and maintained by the Equipment Rental Department at specific rates. [Ord. 1223 § 5, 1979.]

2.68.060 Equipment Reserve Fund – Created – Purpose.

There is created and established a special fund to be known and designated Equipment Reserve Fund, to be used as a revolving reserve fund for the accumulation and investment of monies therein, and for the future replacement and purchase of new equipment. Monies accumulated therein may be transferred as may be provided for in future years’ budgets, to the Equipment Rental Fund for replacement and purchase of new equipment as provided by the City Council. 2.68.070 Recordkeeping.

There shall be kept such books, accounts and records as are necessary to control and report the financial operations of the Equipment Rental Fund and Equipment Reserve Fund, as follows:

A. The Equipment Rental Fund shall be the current operating account, into which shall be placed those portions of the charges made to the various departments of the City, in accordance with the provisions of SMC 2.68.030, which are specifically billed said departments to provide sufficient monies to pay the salaries and wages, materials, overhead, or costs necessary to operate and maintain all rental fund equipment. There shall also be placed into said account monies which may from time to time be made specifically available thereto by action of the Council or transfers from the Equipment Reserve Fund, or other funds as otherwise may have been budgeted for.

B. The Equipment Reserve Fund shall be the reserve account into which shall be placed those portions of charges made to the various departments of the City, in accordance with the provisions of SMC 2.68.030, which are specifically billed said departments to provide sufficient monies (having first taken into consideration the necessary operating and maintenance costs billed under subsection (A) of this section), to pay the costs of purchasing new equipment and replacing used equipment as required to carry out the purposes of the Equipment Rental Fund. There shall also be placed in the Equipment Reserve Fund monies which are derived from the direct sale of any of the equipment or other capital assets of the equipment rental fund and any monies which may from time to time be made specifically available thereto by action of the Council and interest receipts from fund investments. 2.68.080 Withdrawals and expenditures.

Any withdrawals or expenditures from the fund shall be made only in the following manner:

A. Equipment Rental Fund. Expenditures shall be made only upon duly approved payrolls and vouchers of the City for the purposes ascribed to the fund under this chapter and disbursements of treasurer’s check for fund investments.

B. Equipment Reserve Fund. Equipment Reserve Fund expenditures shall be made only upon duly approved vouchers of the City for the purposes ascribed to the fund under this chapter and disbursements by Treasurer’s check for fund investments. [Ord. 1223 § 8, 1979.]

2.68.090 Nontransferability – Dissolution.

A. All monies deposited in the Equipment Rental Fund and not expended as provided under this chapter shall remain in the fund from year to year and shall not be transferred to any other fund or expended for any other purpose whatsoever, except as so authorized and directed by the City Council.

B. If, at any time hereafter, the Mayor and City Council abolish the Equipment Rental Fund and the Equipment Reserve Fund, then all monies remaining on deposit therein shall revert to and be deposited in the several funds and divisions participating in the Equipment Rental Fund operation.
